Participating Interest policy (PI) is a new policy in oil and gas working areas; however, the implementation is not optimal. So there needs to be a study on effectiveness and supervision. This paper aims to discuss the formulation of the problem of the effectiveness of the implementation of PI and supervision by the Aceh Oil and Gas Management Agency (BPMA). This is a pure legal research meaning that it only requires data from relevant laws and analyses them descriptively. The Regulation of the Minister of Energy and Mineral Resources Number 37 of 2016 concerning Provisions for Offering 10% of PI in Oil and Gas Working Areas is an implementing regulation. In addition, the Contractors’ Cooperation Contract is required to offer PI to regions. However, there is no sanction for ignoring it which causes ineffectiveness. The Supreme Audit Agency reveals that Aceh had not yet received PIs from several working areas although the BPMA is entitled to do supervision.

This research set aims to (1) examine the factors motivating the businessmen to sell the subsidized fertilizer beyond its highest retail price, (2) analyze the legal consequences of the unlawful act, and (3) the government efforts to minimize the violation. This research is an empirical legal study, and the data were gathered through library research and interviews with respondents. The results exhibit that (1) the unlawful act was committed for getting high profit, prepaid income, fertilizer limited supply, customer ignorance of highest retail price policy, and transportation expenses, (2) the legal consequences of the unlawful act was that the businessmen were obliged to compensate the customers, and (3) the local government issued a warning letter to the subsidized fertilizer distributors about terminating their contract with an obligation to compensate the customers and provide regulation socialization to related parties.

This research focuses on the sustainability analysis of capture fisheries based on local wisdom in Lhok Kuala Gigieng. This study aims to analyze the sustainability status of capture fisheries and determine the factors that influence the sustainability of capture fisheries in Lhok Kuala Gigieng. The method used in this study is a descriptive method with survey techniques in data collection through questionnaires. The RAPFISH analysis uses four dimensions: ecological, economic, social, and institutional. This study indicates that the sustainability index score for the ecological dimension is in a good category, and the economic dimension of the sustainability index is in the medium category. Furthermore, it also shows that the social dimension of the sustainability index is in a good category, and the institutional dimension of the sustainability index is in a good category.
本研究的重点是基于Lhok Kuala Gigieng当地智慧的捕捞渔业可持续性分析。本研究旨在分析Lhok Kuala Gigieng捕捞渔业的可持续性状况,并确定影响捕捞渔业可持续性的因素。在本研究中使用的方法是描述性的方法与调查技术在数据收集通过问卷调查。RAPFISH分析使用了四个维度:生态、经济、社会和制度。研究表明,生态维度的可持续性指数得分处于良好类别,经济维度的可持续性指数得分处于中等类别。此外,还表明可持续发展指数的社会维度处于良好类别,可持续发展指数的制度维度处于良好类别。

This research aims to examine the effectiveness of Panglima Laot's institution authority in the maritim area to resolve sea disputes and to find an ideal dispute resolution model to be used. This research uses qualitative method by sociological juridical approach in the form of descriptive analytical. The Panglima laot's authority in an effort to assist the government in resolving maritime disputes is a formal authority granted by a law which is attributively regulated in Article 28 of Qanun Aceh Number 10 of 2008 concerning Customary Institutions. However, when dealing with certain cases between fishermen where the regulation is not very clear in the Qanun, Panglima Laot seeks to resolve cases by using traditional approaches, religious values, propriety, a sense of justice and human conscience. Therefore, Panglima Laot needs detailed and written instructions for carrying out tasks in the form of Government Regulations or Qanuns. Including dealing with refugees who come from abroad.

The laws and regulations in Indonesia recognize various legal forms of companies; however, the legal form of a Limited Liability Company is considered to have better business prospects. Limited Liability Company also becomes a legal form of a company that can conduct business in all business fields. This condition has led to the practice of changing the legal form of companies in Indonesia from companies with certain legal forms to the legal form of Limited Liability Companies. This change in the legal form of the company is not covered by a special law that can combine the needs of changing the legal form of the company. In practice, this change in legal form is carried out in various ways that may result in legal uncertainty on one hand, and licensing difficulties as a result of a change in legal form on the other hand. Therefore, a new concept that can create legal certainty and ease doing of business in changing the legal form of companies in Indonesia is needed.

This study aims to analyse and final the ideal legal design of the accountability concept to legislative organ in particular Regional House of Representatives (DPRK). One of The authority of DPRK is stated in Article 24 paragraph (1) of Law Number 11 of 2006 on the Government of Aceh states that: "DPRK has the duty and authority to form district/city qanuns which are discussed with the regents/mayors for mutual approval". In that law, that has not been formulated specific forms of accountability of the legislative organ. In genuine, when the DPRK has not carried out its duties and functions effectively in the field of legislation, there has no legal consequences can be given. This research uses normative legal research with statutory and conceptual approach. The outcomes of this study indicate that, the concept of legislative accountability relates to two aspects, that is political and managerial accountability. This accountability should have electoral implications on the performance of the DPRK in carrying out its functions in the field of legislation. The implementation of legislative accountability on the performance of DPRK in the field of legislation has legal and political consequences.

This study aims to identify the types of state losses associated with the circulation of goods without a distribution permit and the state's authority to demand the return of state losses from dealers of goods without a distribution license. This is normative legal research based on the application of legal principles to the analysis of existing problems, legal analysis, and literature review. The results indicate that the circulation of various types of goods products without distribution permits causes losses, including harming the production and consumption of domestic goods products that already have a distribution license, which causes losses in the economic sector, decreased Non-Tax State Revenues from management, and disruption of public safety and health due to consumer goods without a distribution permit. Criminal law enforcement and Law Number 18, 2012, are the means for prosecuting vendors of goods without distribution permits.

Dalam penelitian ini dirumuskan masalah penelitian yang mencakup bentuk perlindungan hukum yang diberikan pada pengguna Kredit PayLater serta bentuk penyelesaian sengketa dalam bisnis Pinjam-Meminjam berbasis Teknologi dalam layanan PayLater. Dalam penelitian yang berjenis penelitian normative ini diterapkan pendekatan perundang-undangan dan konseptual. Hasil penelitian yang diperoleh menemukan bahwa perlindungan hukum bagi pengguna jasa Kredit PayLater tertuang dalam peraturan UU Perlindungan Konsumen, POJK Nomor 77 /POJK.01/2016 dan UU ITE. Sementara itu, penyelesaian sengketa Kredit PayLater Lebih Efektif dilaksanakan dengan Metode APS (Alternatif Penyelesaian Sengketa) salah satunya dengan cara membuat sebuah lembaga PSD (Penyelesaian Sengketa Daring).

DPR hadir sebagai perwakilan presentatif pemilik kedaulatan sebenarnya, yaitu rakyat di dalam pemerintahan terutama pada penyelenggaraan fungsi legislasi. Putusan MK No. 13/PUU-XVI/2018 tentang Perjanjian Internasional yang tidak mengabulkan permohonan pembatalan terhadap Pasal 2 Undang – Undang Nomor 24 Tahun 2000 tentang Perjanjian Internasional dan merubah tafsir Pasal 11 ayat (1) dan ayat (2) UUD NRI Tahun 1945, telah merubah kewenangan DPR dalam melaksanakan fungsi legislasinya sehingga menimbulkan berbagai kritik dan permasalahan krusial bagi kehidupan berbangsa dan bernegara. Penelitian ini bertujuan menganalisis kedudukan DPR dalam sistem ketatanegaraan Indonesia terhadap perjanjian Internasional dan menganalisis dampak Putusan MK tersebut terhadap kewenangan DPR dalam Perjanjian Internasional. Jenis penelitian yang digunakan adalah adalah penelitian hukum normatif. Pendekatan yang digunakan adalah pendekatan perundang – undangan dan pendekatan konseptual dengan menerapkan metode analisis kualitatif. Hasil penelitian diketahui bahwa: Pasca Putusan MK tersebut membuat kedudukan DPR dalam sistem ketatanegaraan di Indonesia terhadap perjanjian Internasional tidak berada pada tempat yang seharusnya. Dampak Putusan MK tersebut terhadap kewenangan DPR dalam perjanjian Internasional meletakkan kewenangan DPR dalam pembuatan perjanjian Internasional hanya terbatas pada perjanjian dengan subyek hukum selain negara, sehingga kewenangan DPR melemah. Harapannya adalah dilakukan pembatalan terhadap Pasal 2 Undang – Undang Perjanjian Internasional serta mengembalikan tafsir Pasal 11 ayat (1) dan ayat (2) UUD NRI Tahun 1945 seperti sediakala sebelum Putusan MK tersebut, karena sejatinya pasal tersebut adalah pasal yang sudah jelas dan tidak butuh penafsiran baru hanya untuk melegalkan suatu kepentingan golongan tertentu.
