This article reviews the dual positions of the board of commissioners in BUMN companies in order to realize the principles of good corporate governance. The phenomenon of multiple positions is not something new, but the emergence of this phenomenon has caused controversy in the general public. Arrangements regarding male doubles have been regulated in existing regulations such as the BUMN Law, the Public Service Law, and other regulations. There are different rules: there are rules that prohibit and there are rules that allow. However, basically, this is prohibited because a higher law regulates it. This is because commissioners who hold concurrent positions are vulnerable to conflicts of interest, whose actions can disrupt the implementation of good corporate governance. Crime is a social phenomenon that is the responsibility of the state and society because the more crimes that are committed, the greater the danger to the state and society. This study uses normative legal research methods which aim to analyze and evaluate court decisions related to law enforcement of perpetrators of fraudulent online motorcycle taxi ordering fraud. This method will involve literature study and document analysis, namely court decision number 1507/PID.SUS/2018/PN.MDN and decision number 143/PID.B/2018/PN.LMG which is related to the fraudulent case of fictitious online motorcycle taxi orders. The analysis was carried out using a statutory approach and legal theory related to criminal acts of fraud and related court decisions. The results of the analysis will be requested and presented in a narrative form that can provide a deeper understanding related to law enforcement against perpetrators of criminal acts of fraudulent online motorcycle taxi orders. Based on the author's analysis above of the two criminal court decisions in the field of Information and Electronic Transactions Law, it turns out that the authors found that it was very low and did not give a deterrent effect to perpetrators of the Electronic Information and Transactions Law and did not provide a sense of justice to victims.

The problems that the author raises in this study are How to Arrange Online Loans on the Smart Credit Application, How are the Losses arising from online borrowing of the Smart Credit Application and How is the Responsibility of the Smart Credit Application for Losses from Customers.
The research method used by the author in answering problems is Normative Juridical Research where the author tries to examine problems with existing legal rules and uses the literature study method in collecting existing legal materials.
The conclusion of this thesis research is that Online Loans through the Smart “Credit Application in the people of Semarang City are regulated in Article 1320 of the Civil Code which in essence stipulates thatagreements made online must still meet the legal requirements of an agreement. The implementation is regulated in POJK regulation 77/2016 concerning Technology-based Loan Services. Customer protection in online loan agreements can be found in the Consumer Protection Law in article 7 which regulates the Obligations of Business Actors, then Article 8 which regulates things that are prohibited from being done by Business Actors, and Article 18 which regulates the provisions of matters related to the Standard Clause. ITE Law, where in Article 11 and Article 17 of the ITE Law regulates matters related to the validity of electronic agreements, OJK Regulation Number 77 / POJK / 2016 concerning Services of a Loan in the form of Money Based on Information Technology which is regulated through article 18 concerning the Form and Structure of online loan agreements. Dalam proses peradilan anak, terdapat prinsip yang menyatakan jika kepentingan terbaik bagi anak haruslah dipandang sebagai of paramount importence (memperoleh tingkat prioritas yang paling tinggi) di dalam setiap keputusan yang berhubungan dengan anak agar keselamatan dan kesehatan anak dapat diwujudkan. Anak yang menyalahgunakan narkotika dapat dikategorikan sebagai tindak pidana tanpa korban sebab tindakannya menyalahgunakan narkotika itu merugikan pribadinya sendiri, sehingga anak penyalahguna narkotika juga mempunyai hak untuk bisa mendapatkan rehabilitasi dan menjadikan pidana penjara sebagai upaya terakhir dalam proses peradilannya. Namun dalam Putusan Nomor 19/Pid.Sus-Anak/2020/PN Sgm, majelis hakim kurang mempertimbangkan kedudukan anak sebagai subjek hukumnya dengan tidak mencantumkan Undang-Undang Sistem Peradilan Pidana Anak dan Undang-Undang Perlindungan Anak dalam pertimbangannya, sehingga tetap memberikan sanksi pidana penjara tanpa rehabilitasi bagi anak penyalahguna narkotika. Dengan demikian, tujuan dari penelitian ini ialah untuk mengetahui dasar pertimbangan hakim tidak menjatuhkan rehabilitasi kepada anak penyalahguna narkotika dalam Putusan Nomor 19/Pid.Sus-Anak/2020/PN Sgm dan untuk menganalisis penerapan sanksi bagi anak penyalahguna narkotika yang terdapat dalam Putusan Nomor 19/Pid.Sus-Anak/2020/PN Sgm apabila ditinjau berdasarkan UU Sistem Peradilan Pidana Anak dan UU Perlindungan Anak. Penelitian ini dilakukan dengan metode yuridis normatif dengan pendekatan kasus (case approach). Sumber data dalam penelitian ini menggunakan data sekunder dan primer dengan teknik pengumpulan data studi kepustakaan yang kemudian dianalisis secara deskriptif analitis dengan pendekatan kualitatif. Hasil penelitian menyimpulkan bahwa pertimbangan hakim tidak menjatuhkan rehabilitasi kepada anak penyalahguna narkotika dalam Putusan Nomor 19/Pid.Sus-Anak/2020/PN Sgm adalah karena kualifikasi anak sebagai penyalahguna narkotika belum memenuhi salah satu kualifikasi yang terdapat dalam SEMA Nomor 4 Tahun 2010 yaitu berat shabu yang ditemukan masih dibawah 1 (satu) gram. Anak yang menyalahgunakan narkotika dapat dikategorikan sebagai tindak pidana tanpa korban sebab tindakannya menyalahgunakan narkotika itu merugikan pribadinya sendiri, sehingga anak penyalahguna narkotika juga mempunyai hak untuk bisa mendapatkan rehabilitasi dan menjadikan pidana penjara sebagai upaya terakhir dalam proses peradilannya. Namun dalam Putusan Nomor 19/Pid.Sus-Anak/2020/PN Sgm, majelis hakim kurang mempertimbangkan kedudukan anak sebagai subjek hukumnya dengan tidak mencantumkan Undang-Undang Sistem Peradilan Pidana Anak dan Undang-Undang Perlindungan Anak dalam pertimbangannya, sehingga tetap memberikan sanksi pidana penjara tanpa rehabilitasi bagi anak penyalahguna narkotika. Dengan demikian, tujuan dari penelitian ini ialah untuk mengetahui dasar pertimbangan hakim tidak menjatuhkan rehabilitasi kepada anak penyalahguna narkotika dalam Putusan Nomor 19/Pid.Sus-Anak/2020/PN Sgm dan untuk menganalisis penerapan sanksi bagi anak penyalahguna narkotika yang terdapat dalam Putusan Nomor 19/Pid.Sus-Anak/2020/PN Sgm apabila ditinjau berdasarkan UU Sistem Peradilan Pidana Anak dan UU Perlindungan Anak. Penelitian ini dilakukan dengan metode yuridis normatif dengan pendekatan kasus (case approach). Sumber data dalam penelitian ini menggunakan data sekunder dan primer dengan teknik pengumpulan data studi kepustakaan yang kemudian dianalisis secara deskriptif analitis dengan pendekatan kualitatif. Hasil penelitian menyimpulkan bahwa pertimbangan hakim tidak menjatuhkan rehabilitasi kepada anak penyalahguna narkotika dalam Putusan Nomor 19/Pid.Sus-Anak/2020/PN Sgm adalah karena kualifikasi anak sebagai penyalahguna narkotika belum memenuhi salah satu kualifikasi yang terdapat dalam SEMA Nomor 4 Tahun 2010 yaitu berat shabu yang ditemukan masih dibawah 1 (satu) gram. The tender process at the Ministry of Transportation uses an Electronic Procurement System (SPSE) and a supporting system where the final results in the application tendered by the Selection Working Group are only in the form of Minutes of Election Results (BAHP), which are then reported to the Commitment Making Officer (PPK). to be followed up in the form of a Letter of Appointment of Goods/Services Provider (SPPBJ) whether to accept the results of the Working Group or reject it. In the process of determining this, it turned out that there was a legal debate which resulted in legal uncertainty where the Selection Working Group's determination was in the form of BAHP as the result which was used as the object of the lawsuit. Meanwhile, the opinion of the other panel of judges is inversely proportional to the BAHP issue as the object of this dispute. Apart from that, administrative efforts before filing a lawsuit were also a problem where some of the Panel of Judges passed the dismissal stage and some did not.
From the results of the study it was found that the determination of the object of dispute state administrative decisions on the procurement of government goods/services, especially at the Ministry of Transportation of the Republic of Indonesia, was normatively in the basic regulations regarding Government Procurement of Goods/Services, showing the decision to determine the winner of the Working Group in the form of BAHP even though it required approval with PPK can be used as th e object of dispute in disputes over state administrative decisions. In addition, the results also show that the explanations and decisions at the State Administrative Court, the administrative e arrangements for the procurement of goods/services are objections and appeals and a guarantee of 1% (one percent).

Putusan Mahkamah Konstitusi perkara nomor 91/PUU-XVIII/2020 pada tanggal 25 November 2021 yang menguji konstitusionalitas pembentukan Undang-Undang Nomor 11 Tahun 2020 Tentang Cipta Kerja, secara otomatis demi hukum mempengaruhi keberlakuan Peraturan Pemerintah Nomor 36 Tahun 2021 Tentang Pengupahan sebagai aturan teknis administrative kebijakan pengupahan diatur di Indonesia. Kebijakan pengupahan merupakan kebijakan strategis nasional yang bertujuan mewujudkan hak pekerja atas penghidupan yang layak bagi kemanusiaan. Hal ini disebabkan upah merupakan sumber penghasilan yang dimiliki oleh pekerja untuk mencapai derajat penghidupan yang layak bagi dirinya dan keluarganya. Pemerintah menyikapi Putusan ini dengan tetap memberlakukan Undang-Undang Nomor 11 Tahun 2020 Tentang Cipta Kerja termasuk Peraturan Pemerintah Nomor 36 Tahun 2021 Tentang Pengupahan walaupun telah diperintahkan untuk ditangguhkan keberlakuannya sampai dengan pembentuk undang-undang memperbaiki proses pembentukan Undang-Undang Nomor 11 Tahun 2020 Tentang Cipta Kerja. Terlebih Pemerintah melalui Kementerian Ketenagakerjaan mengeluarkan Peraturan Menteri Ketenagakerjaan Republik Indonesia Nomor 18 Tahun 2022 Tentang Penetapan Upah Minimum Tahun 2023 sebagai dasar dalam menetapkan upah minimum tahun 2023 yang akan mengakibatkan ketidakpastian hukum dalam penetapan upah minimum tahun 2023. Penelitian ini menggunakan metode normatif dengan mengacu kepada norma-norma hukum yang terdapat dalam peraturan perundang-undangan maupun putusan pengadilan.

AbstrakSalah satu kebijakan pemerintah dalam pemerataan pembangunan adalah program dana desa yang dikelola langsung oleh pemerintahan desa. Namun menurut Indonesia Corruption Watch (ICW) Dana Desa sangat rawan penyalahgunaan. Selama tahun 2021 terdapat 154 dan nilai kerugian sebesar Rp.233. Oleh sebab itu perlu upaya untuk pencegahan terjadinya tindak pidana korupsi dalam pengelolaan dana desa. Dalam upaya pemberantasan korupsi Perserikatan Bangsa-Bangsa (PBB), melalui United Nation Convention Against Corruption (UNCAC) Tahun 2003 mengamanatkan perlunya mengebangkan kebijakan kontrol sosial yang melibatkan peranserta masyarakat. Di Sumatera Barat, pengelolaan dana desa sebagian besarnya dilasanakan oleh pemerintahan nagari sesuai dengan otonomi yang dimiliki. Penelitian ini dilaksanakan dengan metode penelitian hukum sosiologis yakni untuk melihat penerapan hukum secara konkrit (in conctreto) di tengah masyarakat. Penelitian menghimpun data primer di pemerintahan nagari. Data yang terkumpul akan diolah secara kualitatif. Wawancara dilakukan dengan narasumber yang ada di nagari yakni dengan pemuka masyarakat. Hasil penelitian menunjukkan bahwa partisipasi masyarakat dalam pengelolaan dana desa dilaksanakan di semua tahapan, baik dalam perencanaan melalui Musrembang, dan dalam pelaksanan. Partisipasi dalam pengawasan dilaksanakan sesuai dengan aturan negara dan aturan hukum adat yang ada di nagari melibatkan semu komponen nagari. Partisipasi masyarakat dalam pengelolaan nagari sangat urgen dalam keberhasil pengelolaan dana desa karena perencanaannya sesuai dengan aspirasi masyarakat.
