This article reviews the dual positions of the board of commissioners in BUMN companies in order to realize the principles of good corporate governance. The phenomenon of multiple positions is not something new, but the emergence of this phenomenon has caused controversy in the general public. Arrangements regarding male doubles have been regulated in existing regulations such as the BUMN Law, the Public Service Law, and other regulations. There are different rules: there are rules that prohibit and there are rules that allow. However, basically, this is prohibited because a higher law regulates it. This is because commissioners who hold concurrent positions are vulnerable to conflicts of interest, whose actions can disrupt the implementation of good corporate governance. Based on this matter, BUMN commissioners are prohibited from holding concurrent positions.

Partai politik mempunyai kewenangan terhadap kadernya yang menjadi wakil rakyat demi menjamin kekuatan dan eksistensi Partai politik di parlemen, salah satu kewenangan partai politik terhadap wakil rakyat adalah Pergantian Antar Waktu (PAW) yang digunakan oleh partai politik terhadap anggota Dewan Perwakilan Rakyat yang berasal dari partai politik tersebut, partai politik berhak memberhentikan kader politiknya yang dianggap melanggar aturan partai maupun konstitusi. Dalam penelitian ini akan membahas bagaimana problematikan Pergantian Antar Waktu anggota DPRD Kabupaten Paniai menurut Undang-Undang Nomor 17 Tahun 2014. Metode Penelitian yang digunakan adalah penelitian normatif yaitu penelitian yang berdasarkan pada kajian teori, asas, ataupun peraturan hukum tertulis lain yang ada yang kemudian akan dikaji dari berbagai aspek seperti aspek teori, sejarah, filosofi, perbandingan, struktur dan komposisi, lingkup dan materi, konsistensi, serta penjelasan umum dan pasal demi pasal. Problematika terjadi dalam menjalankan mekanisme Pergantian Antar Waktu AMOS KEGIBUI MUYAPA di DPRD Kabupaten Paniai dari fraksi Partai Keadilan Sejahtera. Problematika dan keterlambatan yang dihadapi AMOS KEGIBUI MUYAPA bertentangan dengan peraturan perundang-undangan, Urgensi menjalankan Pergantian Antar Waktu (PAW) harus dilakukan untuk meningkatkan kekuatan dan eksistensi dari Partai Keadilan Sejahtera dan oposisi di parlemen demi membangun kekuatan politik dalam menghadapi pemilihan umum 2024.

Rule point 3 of the UUPA states that the use and exploitation of agrarian lands, especially the management of ulayat land, is carried out by customary leaders (Kepala Adat) and the utilization is intended for both members of the customary law community concerned and people who are not part of the customary or local law community. The approach method used in the preparation of this thesis is normative juridical research (normative legal research method). The normative juridical research method is a legal research library conducted by examining library materials or secondary data. By using the deductive method of thinking (a way of thinking in drawing conclusions from something general that has been proven true and that conclusion is aimed at something specific). Based on the analysis that the author conducted regarding the Recognition of Ulayat Rights in the Republic of Indonesia, the district/city government is the first line to provide recognition and protection of customary rights over customary law community lands. Regional autonomy, which forms local governments that are close to the people, is expected to increase legal recognition and protection of the customary rights of customary law communities which are often neglected in state life. Crime is a social phenomenon that is the responsibility of the state and society because the more crimes that are committed, the greater the danger to the state and society. This study uses normative legal research methods which aim to analyze and evaluate court decisions related to law enforcement of perpetrators of fraudulent online motorcycle taxi ordering fraud. This method will involve literature study and document analysis, namely court decision number 1507/PID.SUS/2018/PN.MDN and decision number 143/PID.B/2018/PN.LMG which is related to the fraudulent case of fictitious online motorcycle taxi orders. The analysis was carried out using a statutory approach and legal theory related to criminal acts of fraud and related court decisions. The results of the analysis will be requested and presented in a narrative form that can provide a deeper understanding related to law enforcement against perpetrators of criminal acts of fraudulent online motorcycle taxi orders. Based on the author's analysis above of the two criminal court decisions in the field of Information and Electronic Transactions Law, it turns out that the authors found that it was very low and did not give a deterrent effect to perpetrators of the Electronic Information and Transactions Law and did not provide a sense of justice to victims. The background of this thesis is that it starts from the rapid growth of information technology-based lending service providers, apparently not balanced with adequate education to the public, causing various effects / risks that arise from the many kinds of online loans and there are still many unregistered or illegal organizing companies found as well as the potential for leaking user personal data that can be misused by the organizing company or another party One of the platforms is the Smart Credit App. The problems that the author raises in this study are How to Arrange Online Loans on the Smart Credit Application, How are the Losses arising from online borrowing of the Smart Credit Application and How is the Responsibility of the Smart Credit Application for Losses from Customers. The research method used by the author in answering problems is Normative Juridical Research where the author tries to examine problems with existing legal rules and uses the literature study method in collecting existing legal materials. The conclusion of this thesis research is that Online Loans through the Smart “Credit Application in the people of Semarang City are regulated in Article 1320 of the Civil Code which in essence stipulates thatagreements made online must still meet the legal requirements of an agreement. The implementation is regulated in POJK regulation 77/2016 concerning Technology-based Loan Services. Customer protection in online loan agreements can be found in the Consumer Protection Law in article 7 which regulates the Obligations of Business Actors, then Article 8 which regulates things that are prohibited from being done by Business Actors, and Article 18 which regulates the provisions of matters related to the Standard Clause. ITE Law, where in Article 11 and Article 17 of the ITE Law regulates matters related to the validity of electronic agreements, OJK Regulation Number 77 / POJK / 2016 concerning Services of a Loan in the form of Money Based on Information Technology which is regulated through article 18 concerning the Form and Structure of online loan agreements. The disadvantage that often arises from the Smart Credit Application is the dissemination of personal data carried out by the Smart Credit Application because the Debtor does not make payments on time, so the debt Collector uses techniques to use the dissemination of personal data to pressure the Debtor to immediately make payments, Juridical Responsibility The Kredit Pintar application for actions committed for defamation can be held civil liability through a Tort Lawsuit as stipulated in article” 1365 of the Civil Code filed by Customers who feel aggrieved because their identity is used in the misuse of personal data.  The research method used by the author in answering problems is Normative Juridical Research where the author tries to examine problems with existing legal rules and uses the literature study method in collecting existing legal materials.
 The conclusion of this thesis research is that Online Loans through the Smart “Credit Application in the people of Semarang City are regulated in Article 1320 of the Civil Code which in essence stipulates thatagreements made online must still meet the legal requirements of an agreement. The implementation is regulated in POJK regulation 77/2016 concerning Technology-based Loan Services. Customer protection in online loan agreements can be found in the Consumer Protection Law in article 7 which regulates the Obligations of Business Actors, then Article 8 which regulates things that are prohibited from being done by Business Actors, and Article 18 which regulates the provisions of matters related to the Standard Clause. ITE Law, where in Article 11 and Article 17 of the ITE Law regulates matters related to the validity of electronic agreements, OJK Regulation Number 77 / POJK / 2016 concerning Services of a Loan in the form of Money Based on Information Technology which is regulated through article 18 concerning the Form and Structure of online loan agreements. The disadvantage that often arises from the Smart Credit Application is the dissemination of personal data carried out by the Smart Credit Application because the Debtor does not make payments on time, so the debt Collector uses techniques to use the dissemination of personal data to pressure the Debtor to immediately make payments, Juridical Responsibility The Kredit Pintar application for actions committed for defamation can be held civil liability through a Tort Lawsuit as stipulated in article” 1365 of the Civil Code filed by Customers who feel aggrieved because their identity is used in the misuse of personal data.

Dalam proses peradilan anak, terdapat prinsip yang menyatakan jika kepentingan terbaik bagi anak haruslah dipandang sebagai of paramount importence (memperoleh tingkat prioritas yang paling tinggi) di dalam setiap keputusan yang berhubungan dengan anak agar keselamatan dan kesehatan anak dapat diwujudkan. Anak yang menyalahgunakan narkotika dapat dikategorikan sebagai tindak pidana tanpa korban sebab tindakannya menyalahgunakan narkotika itu merugikan pribadinya sendiri, sehingga anak penyalahguna narkotika juga mempunyai hak untuk bisa mendapatkan rehabilitasi dan menjadikan pidana penjara sebagai upaya terakhir dalam proses peradilannya. Namun dalam Putusan Nomor 19/Pid.Sus-Anak/2020/PN Sgm, majelis hakim kurang mempertimbangkan kedudukan anak sebagai subjek hukumnya dengan tidak mencantumkan Undang-Undang Sistem Peradilan Pidana Anak dan Undang-Undang Perlindungan Anak dalam pertimbangannya, sehingga tetap memberikan sanksi pidana penjara tanpa rehabilitasi bagi anak penyalahguna narkotika. Dengan demikian, tujuan dari penelitian ini ialah untuk mengetahui dasar pertimbangan hakim tidak menjatuhkan rehabilitasi kepada anak penyalahguna narkotika dalam Putusan Nomor 19/Pid.Sus-Anak/2020/PN Sgm dan untuk menganalisis penerapan sanksi bagi anak penyalahguna narkotika yang terdapat dalam Putusan Nomor 19/Pid.Sus-Anak/2020/PN Sgm apabila ditinjau berdasarkan UU Sistem Peradilan Pidana Anak dan UU Perlindungan Anak. Penelitian ini dilakukan dengan metode yuridis normatif dengan pendekatan kasus (case approach). Sumber data dalam penelitian ini menggunakan data sekunder dan primer dengan teknik pengumpulan data studi kepustakaan yang kemudian dianalisis secara deskriptif analitis dengan pendekatan kualitatif. Hasil penelitian menyimpulkan bahwa pertimbangan hakim tidak menjatuhkan rehabilitasi kepada anak penyalahguna narkotika dalam Putusan Nomor 19/Pid.Sus-Anak/2020/PN Sgm adalah karena kualifikasi anak sebagai penyalahguna narkotika belum memenuhi salah satu kualifikasi yang terdapat dalam SEMA Nomor 4 Tahun 2010 yaitu berat shabu yang ditemukan masih dibawah 1 (satu) gram. Selain itu, penerapan sanksi bagi anak penyalahguna narkotika yang terdapat dalam Putusan Nomor 19/Pid.Sus-Anak/2020/PN Sgm yang dijatuhkan vonis 3 (tiga) bulan penjara tanpa rehabilitasi dirasa kurang tepat karena tidak sesuai dengan ketentuan dari Pasal 54 Undang-Undang Narkotika, Pasal 81 Ayat (1) dan Ayat (5) Undang-Undang Sistem Peradilan Pidana Anak, serta Pasal 67 Undang-Undang Perlindungan Anak.

SENGKETA KEPUTUSAN TATA USAHA NEGARA PADA PENGADAAN BARANG/JASA PEMERINTAH DI KEMENTERIAN PERHUBUNGAN REPUBLIK INDONESIA 关于印尼共和国交通部政府采购/服务的行政决定的争议

The tender process at the Ministry of Transportation uses an Electronic Procurement System (SPSE) and a supporting system where the final results in the application tendered by the Selection Working Group are only in the form of Minutes of Election Results (BAHP), which are then reported to the Commitment Making Officer (PPK). to be followed up in the form of a Letter of Appointment of Goods/Services Provider (SPPBJ) whether to accept the results of the Working Group or reject it. In the process of determining this, it turned out that there was a legal debate which resulted in legal uncertainty where the Selection Working Group's determination was in the form of BAHP as the result which was used as the object of the lawsuit. Meanwhile, the opinion of the other panel of judges is inversely proportional to the BAHP issue as the object of this dispute. Apart from that, administrative efforts before filing a lawsuit were also a problem where some of the Panel of Judges passed the dismissal stage and some did not. From the results of the study it was found that the determination of the object of dispute state administrative decisions on the procurement of government goods/services, especially at the Ministry of Transportation of the Republic of Indonesia, was normatively in the basic regulations regarding Government Procurement of Goods/Services, showing the decision to determine the winner of the Working Group in the form of BAHP even though it required approval with PPK can be used as th e object of dispute in disputes over state administrative decisions. In addition, the results also show that the explanations and decisions at the State Administrative Court, the administrative e arrangements for the procurement of goods/services are objections and appeals and a guarantee of 1% (one percent). Putusan Mahkamah Konstitusi perkara nomor 91/PUU-XVIII/2020 pada tanggal 25 November 2021 yang menguji konstitusionalitas pembentukan Undang-Undang Nomor 11 Tahun 2020 Tentang Cipta Kerja, secara otomatis demi hukum mempengaruhi keberlakuan Peraturan Pemerintah Nomor 36 Tahun 2021 Tentang Pengupahan sebagai aturan teknis administrative kebijakan pengupahan diatur di Indonesia. Kebijakan pengupahan merupakan kebijakan strategis nasional yang bertujuan mewujudkan hak pekerja atas penghidupan yang layak bagi kemanusiaan. Hal ini disebabkan upah merupakan sumber penghasilan yang dimiliki oleh pekerja untuk mencapai derajat penghidupan yang layak bagi dirinya dan keluarganya. Pemerintah menyikapi Putusan ini dengan tetap memberlakukan Undang-Undang Nomor 11 Tahun 2020 Tentang Cipta Kerja termasuk Peraturan Pemerintah Nomor 36 Tahun 2021 Tentang Pengupahan walaupun telah diperintahkan untuk ditangguhkan keberlakuannya sampai dengan pembentuk undang-undang memperbaiki proses pembentukan Undang-Undang Nomor 11 Tahun 2020 Tentang Cipta Kerja. Terlebih Pemerintah melalui Kementerian Ketenagakerjaan mengeluarkan Peraturan Menteri Ketenagakerjaan Republik Indonesia Nomor 18 Tahun 2022 Tentang Penetapan Upah Minimum Tahun 2023 sebagai dasar dalam menetapkan upah minimum tahun 2023 yang akan mengakibatkan ketidakpastian hukum dalam penetapan upah minimum tahun 2023. Penelitian ini menggunakan metode normatif dengan mengacu kepada norma-norma hukum yang terdapat dalam peraturan perundang-undangan maupun putusan pengadilan.

AbstrakSalah satu kebijakan pemerintah dalam pemerataan pembangunan adalah program dana desa yang dikelola langsung oleh pemerintahan desa. Namun  menurut Indonesia Corruption Watch (ICW) Dana Desa sangat rawan penyalahgunaan. Selama tahun 2021 terdapat 154  dan nilai kerugian sebesar Rp.233. Oleh sebab itu perlu upaya untuk pencegahan terjadinya tindak pidana korupsi dalam pengelolaan dana desa. Dalam upaya pemberantasan  korupsi Perserikatan Bangsa-Bangsa (PBB), melalui  United Nation Convention Against Corruption (UNCAC) Tahun 2003 mengamanatkan perlunya mengebangkan kebijakan kontrol sosial yang melibatkan peranserta masyarakat. Di Sumatera Barat, pengelolaan dana desa sebagian besarnya dilasanakan oleh pemerintahan nagari sesuai dengan otonomi yang dimiliki. Penelitian ini dilaksanakan dengan metode penelitian hukum sosiologis yakni untuk melihat penerapan hukum secara konkrit (in conctreto) di tengah masyarakat. Penelitian menghimpun data primer di pemerintahan nagari. Data yang terkumpul akan diolah secara kualitatif. Wawancara dilakukan dengan narasumber yang ada di nagari yakni dengan pemuka masyarakat. Hasil penelitian menunjukkan bahwa partisipasi masyarakat dalam pengelolaan dana desa dilaksanakan di semua tahapan, baik dalam perencanaan melalui Musrembang, dan dalam pelaksanan. Partisipasi dalam pengawasan dilaksanakan sesuai dengan aturan negara dan aturan hukum adat yang ada di nagari melibatkan semu komponen nagari. Partisipasi masyarakat dalam pengelolaan nagari sangat urgen dalam keberhasil pengelolaan dana desa karena perencanaannya sesuai dengan aspirasi masyarakat. Partisipasi masyarakat perlu dioptimalkan melalui suatu sistem partisipasi masyarakat secara lebih komprehensif.

Di Sumatera Barat, pengelolaan dana desa sebagian besarnya dilasanakan oleh pemerintahan nagari sesuai dengan otonomi yang dimiliki.
