Zbog sve intenzivnijeg korištenja digitalnih alata u radu radnik često biva stalno dostupan poslodavcu, što može rezultirati kršenjem odredbi o ograničenom radnom vremenu i obveznom razdoblju odmora, narušiti ravnotežu privatnog i poslovnog života i ugroziti zdravlje radnika. Uvođenjem prava na isključivanje radnika nastoji se spriječiti, ublažiti ili otkloniti takve negativne posljedice. U radu se analizira uređenje prava na isključivanje u pravu EU-a, nacionalnim zakonodavstvima nekoliko država članica EU-a te hrvatskom zakonodavstvu, praksa Suda EU-a u vezi s primjenom Direktive o radnom vremenu te uloga socijalnih partnera u uređivanju i ostvarivanju ovog prava.

Mjera djelomičnog umirovljenja trebala bi biti koncipirana tako da motivira ljude da duže ostanu u svijetu rada i odgode svoje potpuno umirovljenje, kako bi se smanjio pritisak na mirovinski sustav i spriječio rast njegove rashodovne strane. Dakle, na individualnoj razini mjera bi trebala pridonijeti postupnom umirovljenju i većoj primjerenosti mirovina, a na sustavnoj razini poboljšanju održivosti mirovinskog sustava. Međutim, Hrvatska je uvela 2014. godine model djelomičnog umirovljenja s pravom na punu mirovinu, prvo samo za korisnike starosnih mirovina, a poslije je to pravo proširila i na korisnike prijevremenih starosnih i obiteljskih mirovina. U radu se, nakon kratkih teorijskih razmatranja i sažetih komparativnih usporedbi, analizira hrvatsko zakonsko uređenje i statistički podatci vezani za djelomično umirovljenje. Provedena analiza upućuje na to da hrvatski model ima nekoliko nepoželjnih učinaka: privlači ljude u mirovinu, dovodi do većeg opterećenja mirovinskog sustava, ne pridonosi povećanju mirovina te potencijalno uzrokuje distorzije na tržištu rada.

This paper offers some reflections on comparative scientific research in the field of labour law by reference to the former socialist countries of Europe prior to 1989. The focus is primarily upon approaches to collaborative research and techniques for comparative evaluation rather than any attempt to deliver a detailed elaboration of “socialist labour law”. The perspective is that of a British labour lawyer whose contemporaneous activities extended to publication, research and teaching projects in collaboration with a broad range of socialist academic experts of the time. This presentation sets out by noting the relative lack of attention paid to experiences in those socialist legal systems – in part as a result of difficulties in accessing and understanding scientific works published in the official languages of those countries, but also due to widespread scepticism on the parts of non-socialist researchers towards the value of work undertaken by the academic community in the socialist countries. The author points to the importance of studying experiences of these legal systems not only for the sake of historical reflection but also by virtue of insights that those experiences can offer to an appreciation of labour law as it has developed post-1989. The historical context provided by this work thus highlights the opportunity for reflection in relation to concrete national systems, as well as clearly illustrating the timeless importance of conducting comparative research on labour law. Emphasis is placed upon the need for an inclusive approach to the study of labour law in order to discern the totality of developments in that field, rather than limiting the focus to regionally oriented developments as scientific facts and the drawing of conclusions based on them. In the course of presenting this paper, the author also provides an insight into the career of Prof. Željko Potočnjak, whose position as a prominent scholar of labour law in Central and Eastern Europe is considered through the prism of personal recollections and illustrations of the significance accorded to his contributions in that area.

Hrvatska je poznata po sjajnim uspjesima svojih sportašica i sportaša. No, takav uspjeh i sjajne rezultate ne prati odgovarajući pravni okvir. Ponajprije se tu misli na uređenje ugovornog odnosa profesionalnih sportašica i sportaša s klubovima. Unatoč činjenici da je u svim uređenim pravnim sustavima odavno prihvaćeno da profesionalni sportaši uživaju radnopravnu i socijalnopravnu zaštitu, Hrvatska ni novim Zakonom o sportu nije napravila taj toliko nužan iskorak. Štoviše, države EU-a praćene i podržane od strane Međunarodne organizacije rada te sportskih udruženja najviše razine poduzimaju korake kako radnopravnu i socijalnopravnu zaštitu proširiti i na sportaše iz pojedinačnih sportova, ne samo ekipnih. U radu se daje i komparativna analiza uređenja pojedinih država EU-a te analiza relevantnih odredbi Zakona o sportu.

Telework has become prevalent during the COVID-19 pandemic, which has changed the way we look at work. However, the current EU rules for social security coordination were not designed to accommodate telework, with the lex loci laboris principle being understood in practical terms. During the pandemic, the European Commission initially suspended the coordination regulation rules to prevent sudden changes for workers, which caused unintended consequences and potential discrimination against intra-community migrants. To address these issues, options include changing the legal text of the coordination regulation, reinterpreting coordination rules, or concluding bilateral or multilateral agreements. Failure to take action could lead to continued discrimination by companies. In this regard, if no legislative action is taken, at least a common approach within the context of the Administrative Commission should be envisaged to ensure uniformity at the European level. The recent developments within the context of the Administrative Commission at least seem to go in that direction.

Sustainability is on everyone´s lips. It is also increasingly influencing Union legislation. Recently, the Corporate Sustainability Reporting Directive came into force. The Directive also contains requirements regarding sustainability reporting on social issues. These are concretised by the specific disclosure requirements developed by the European Financial Reporting Advisory Group (EFRAG). This article takes a critical look at the Directive and in particular its content with regard to labour law issues, but also at the role of EFRAG in substantiating the reporting obligations of companies.

The point of departure of this paper is that, in Slovenia, the implementation of the Strike Act, which was adopted still in former Yugoslavia requires profound changes as it is not in line with the constitutional concept of the right to strike or with the basic approaches of international norms and/or the interpretations of these norms made by the relevant supervisory bodies. The focus is placed exclusively on the European Social Charter and its supervisory body – the European Committee of Social Rights. The author briefly comments on certain (inadequate) solutions in the domestic legal regime and its implementation. She indicates possible changes de lege ferenda following the interpretations of the European Social Charter, derived from the case-law of the European Committee of Social Rights. Special attention is drawn to the inadequate legislation which determines limitations to the right to strike of workers in state bodies and public services.

U radu se analizira primjena pravila Zakona o obveznim odnosima na ugovore i druge pravne poslove koji su uređeni Zakonom o radu. Osim što Zakon o radu predviđa podrednu primjenu pojedinih pravila Zakona o obveznim odnosima, njihova primjena također proizlazi i iz odnosa općeg i posebnog uređenja u području ugovornog prava odgovornosti za štetu. UN je na prekretnici. Trendovi u pogledu triju stupova na kojima počiva, mira i sigurnosti, razvoja, i ljudskih prava, negativni su. Riječ je o paradoksu: globalna koordinacija i upravljanje nikada nisu bili važniji – istodobno, UN nikada nije bio manje relevantan. UN očito treba bolje prilagoditi novim izazovima, ali, promijeniti njegovu Povelju je vrlo teško jer se za to traži dvotrećinska većina i suglasnost svih pet stalnih članica VS-a. Zato UN treba, koliko je god to moguće, pokušati reformirati putem inovativnih rješenja koja (premda ih izričito ne spominje) slijede duh Povelje, kao i kroz kreativnu interpretaciju njezinih odredaba te savjetodavna mišljenja Međunarodnog suda pravde. Bez obzira na kreativnost, to ipak ima ograničeni domet, te stoga treba razmišljati i o mogućnosti radikalne reforme UN-a, te alternativnim modelima globalne koordinacije i upravljanja, razraditi odgovarajuće prijedloge te nadati se da će se zvijezde ipak jednom posložiti za njihovo prihvaćanje.

Kriteriji znanstvene izvrsnosti su u svakoj, osobito relativno maloj znanstvenoj zajednici poput Hrvatske, neophodan ali i neizostavan društveni sustav poticaja, odgovornosti i očekivanja od znanstvenika (doktora znanosti) kao vrha hrvatske znanstveno-obrazovne piramide. Istodobno, oni su i iskaz “samoorganiziranosti” ovog populacijski uskog segmenta hrvatskog društva. Znanstvenici njima oblikuju svoju osobnu i zajedničku potrebu i obvezu kontinuirane potvrde svoje intelektualne radoznalosti i talenta, istraživačkom predanošću i marljivošću, te mjerljivim i struci ali i široj društvenoj zajednici razumljivim rezultatima. Samo stručno razumna i društveno nijansirana kombinacija institucionalne (vanjske) kontrole i (unutarnje) samoodgovornosti znanstvenika može rezultirati objektivnom ocjenom znanstvenog doprinosa i potaknuti rast znanstvene produktivnosti. U tom smislu se u radu propituju kvantitativni i kvalitativni indikatori mjerenja znanstvene izvrsnosti, njihov međusoban odnos, te dinamika mijenjajućih pozicija pojedinih indikatora u cjelovitoj prosudbi kvalitete i primjenljivosti znanstvenih nalaza tijekom vremena.
