Efektivitas Fungsi Pengawasan Oleh Majelis Pengawas Daerah Terhadap Notaris Yang Meninggalkan Wilayah Jabatannya 县监督委员会对离开司法部的公证员的监督职能的有效性

Penelitian ini bertujuan untuk menganalisis dan menjelaskan bentuk tanggung jawab pengawas Majelis Pengawas Daerah (MPD) terhadap notaris yang meninggalkan wilayah jabatannya tanpa alasan yang sah dan merumuskan dan mengidentifikasi efektivitas fungsi pengawas Majelis Pengawas Daerah (MPD) terhadap notaris yang meninggalkan wilayah jabatannya tanpa alasan yang sah. Penelitian ini adalah penelitian hukum empirik, lokasi penelitian ini dilakukan di Kota Makassar, Sulawesi Selatan. Hasil penelitian menunjukkan bahwa pengawasan yang dilakukan terhadap Notaris dimaksudkan agar Notaris dalam menjalankan tugas jabatannya berdasarkan aturan sesuai ketentuan peraturan perundang-undangan yang mengatur jabatan Notaris. Peraturan perundang-undangan yang mengatur jabatan tidak hanya mensyaratkan hukum atau undang-undang saja, akan tetapi juga berdasarkan kepercayaan yang diberikan oleh para pihak terhadap Notaris tersebut. Notaris harus bersikap profesional dalam menjalankan jabatannya, karena jabatan Notaris merupakan jabatan kepercayaan yang harus selaras dengan mereka yang menjalankan tugas jabatan Notaris sebagai orang yang dapat dipercaya. Notaris sebagai jabatan kepercayaan tidak berarti apa-apa jika ternyata mereka yang menjalankan tugas jabatan sebagai Notaris sebagai orang yang tidak dapat dipercaya, termasuk meninggalkan wilayah jabatannya tanpa alasan yang sah.
本研究的目的是分析和解释区域监督员(MPD)对无正当理由离职的公证人的责任形式和损害,并确定区域监督员对无正当原因离职的公证员的职能有效性。本研究为实证法研究,本研究地点位于南苏拉威西省望加锡市。结果表明,对公证人进行监督的目的是让公证人按照管理公证人办公室的邀请规则中规定的规则履行职责。管理该办公室的规则不仅是法定的或法定的,而且基于各方对公证人的信任。Notaris在管理他的办公室时必须是专业的,因为Notaris是一个信托办公室,必须与那些作为值得信赖的人做Notaris的人保持一致。公证人作为一个信托部门,如果那些履行公证人职能的人是一个不可靠的人,包括无正当理由离职,那么公证人就没有任何意义。

Badan Wakaf Indonesia (BWI) dibentuk berdasarkan Pasal 47 Undang-Undang Nomor 41 Tahun 2004, BWI merupakan lembaga independen dalam melaksanakan tugasnya, melakukan pembinaan terhadap  nazhir, mengelola dan mengembangkan harta benda wakaf. Penelitian ini akan menjelaskan: (1) Implementasi Peran BWI dalam Pengelolaan dan Pengembangan Wakaf dan, (2)  Pertanggungjawaban BWI dalam pengelolaan dan pengembangan harta benda wakaf, dengan menggunakan pendekatan teori kelembagaan, regulasi dan kemanfaatan. Metode penelitian dilakukan melalui pendekatan yuridis normatif dari bahan kepustakaan menggunakan data sekunder berupa antara lain peraturan perundang-undangan tentang wakaf, putusan pengadilan, jurnal, peneliatan ilmiah tentang wakaf, buku-buku, surat kabar media online dan internet. kesimpulan dari penelitian adalah sebagai berikut; BAB III menjelaskan implementasi tentang tugas dan wewenang BWI. melakukan pembinaan terhadap nazhir, mengelola dan mengembangkan harta benda wakaf berskala nasional dan internasional; BAB IV, Pertanggungjawaban BWI dalam melaksanakan tugasnya bertanggung jawab kepada Presiden dilakukan melalui laporan tahunan yang disampaikan kepada menteri agama. BAB V. Kesimpulan: (1) tugas dan wewenang BWI adalah  melakukan pembinaan terhadap nazhir, mengelola dan mengembangkan harta benda wakaf berskala nasional dan internasional, (2) BWI dalam melaksanakan tugasnya bertanggung jawab kepada Presiden dilakukan melalui laporan tahunan yang disampaikan kepada menteri agama.  Untuk efektivitas BWI sebagai lembaga independen dalam menjalankan tugasnya memajukan perwakafan nasional, penulis memberikan saran-saran sebagai berikut: (1) Perlu dilakukan perubahan status kelembagaan BWI yang independen secara mandiri tanpa campur tangan dan/atau pengaruh kementerian agama, (2). Untuk menghindari tumpang tindih antara tugas dan kewenangan, BWI hanya bertugas sebagai badan pengawas saja tidak merangkap sebagai badan pelaksana.

Status Hukum Narapidana Pasca Putusan Hakim Mengisi Jabatan Pemerintahan Berdasarkan Undang-Undang Nomor 7 Tahun 2017 Tentang Pemilihan Umum 根据2017年关于大选的第7号法律,政府在职法官的地位

Komisi Pemilihan Umum (KPU) merupakan lembaga negara yang diakui oleh konstitusi sebagai penyelenggara pemilihan umum sebagaimana tertuang didalam Undang-Undang Dasar 1945 Pasal 22E ayat (5) berbunyi “Pemilihan umum diselenggarakan oleh suatu komisi pemilihan umum yang bersifat nasional, tetap, dan mandiri”. Melalui Putusan Mahkamah Konstitusi Nomor 04/PUU-VII/2009 ini memberikan legalitas status hukum terhadap mantan terpidana untuk mengikuti pemilihan umum, baik pemilihan legislatif di tingkat Provinsi maupun di Kabupaten/Kota dengan syarat dikecualikan bagi mantan narapidana yang secara terbuka dan jujur mengemukakan kepada publik bahwa yang bersangkutan mantan narapidana. Metode penelitian yang dipergunakan adalah  metode penelitian yurisi normatif. Penelitian normatif mengaharuskan pendekatan peraturan perundang-undangan (statute Approach) dan pendekatan konseptual. Teknik pengumpulan data yang digunakan yakni melalui studi dokumen maupun kepustakaan terhadap data-data sekunder berupa bahan-bahan hukum primer, sekunder dan tersier.  Kesimpulannya ditemukan bahwa status mantan terpidana yang akan mengikuti pemilihan legislatif mandapat kepastian semanjak keluarnya keputusan Mahkamah Konstitusi seiring dengan Undang-Undangn Nomor 7 Tahun 2017 tentang pemilihan Umum Kata Kunci: Status Hukum, Mantan Terpidana, Putusan Hakim

Parecidos de familia: contenido e importancia de una idea de Wittgenstein 家庭相似:维特根斯坦思想的内容和意义

According to the main thesis of this article, in order to articulate the scope and interest of Wittgenstein’s family resemblances topic, we should see into it not an answer to the question what concepts in general are, but a methodological proposal. Two questions guide the central part of the text: (1) What does “family - resemblances concepts” mean? (2) What concepts fall within the corresponding class? Regarding (1) I try to show that “family - resemblances concepts” is not an unequivocal term: a first sense has to do with the dictum of “similarities overlapping and criss - crossing” (IF 67) and is to be distinguished from a second sense associated with the topic of “blurred edges” (IF 71). This distinction lies behind the answer I offer to (2): in the first sense of the term, there is no family concept at all, while according to the second sense all concepts are of this kind. In the final part I propose a reinterpretation of the issue from a methodological perspective. To say that concepts like language, understanding, thinking, etc. are family concepts means that the philosophical reflection on them should not centre on the praxis of looking for definitions. As important ― maybe more important ― as that it’s the careful description of paradigmatic examples, as “centers of variation” (EPB 190).

La problemática de la profesionalización de la clase política y el potencial del sorteo a través de minipúblicos deliberativos 政治阶层专业化的问题和通过审议微型公众进行抽奖的潜力

One of the greatest challenges to be overcome by contemporary electoral representative democracies is to alleviate citizen disaffection and, consequently, bridge the gap between the rulers and the ruled. A certain consensus could be reached if we affirmed that the professionalization of politicians is becoming one of the obstacles that citizens face when it comes to trusting the political system. I In this sense, the main objective of this article is to reflect on the harmful effects of the professionalization of the political class and analyze the potential of the sortition as a neutralizing mechanism. In turn, find out if this, through deliberative mini publics, has or not the ability to minimize its harmful excesses and, with it, increase the degree of trust of citizens with their political representatives.

Derecho al desarrollo y Doctrina Social de la Iglesia (DSI) 发展权和教会社会教义

This paper expounds the history of the interaction between the concept of right to development as it is understood in international politics and law with the statements of the Catholic Social Teaching about development. The results of this research show the different conceptual transformations of development throughout the second half of the 20th century and early 21st century, expressed in the use of different adjectives that qualify development to stress different perspectives. There has been variation not only in the adjectives but also in the legal instruments used to promote development, that had led to a relative obsolescence of the concept of right to development. Presently, sustainable development is the key concept that vehicles the thrust of the promotion of development in the international system and it has also made its way to official Church teaching. The article finally under-lines how recent questioning of the very concept of development in recent academic literature, which show the limits of the growth paradigm due to ecological planetary limits, have not been duly discussed in official statements and catholic theology. This is an emerging debate, but it is gaining momentum and will surely require discussion in catholic approaches to the problem of development.

This article shows how the liberalism of the Chilean philosopher Jenaro Abasolo (1833-1884), by granting an active role to the State in the “empowerment of the disinherited mass”, responds to the adjective “social”. In Abasolo, the duty to ensure as far as possible the prosperity of the people is based on natural law and on a pan[en]theistic theology of history akin to Krausism. Abasolo thinks that the redemption of the disinherited in even juvenile nations must be supported by an “almost socialist” form of state. This implies an action of centralization and guardianship of the people that confronts the authors of the article with the great difficulty of determining how the Chilean author makes the transition from an empowerment consummated through a good degree of despotism, towards freedom. That is to say, it is controversial to establish the feasibility of the realization of this quasi-socialist path to a liberalism counterfactually oriented by laissez faire.
