Efektivitas Persidangan Berbasis E-Court 基于电子法庭的效率

E-Court (Pengadilan Elektronik) adalah aplikasi yang berisi layanan untuk Pengguna Terdaftar untuk kasus online pendaftaran, memperoleh perkiraan biaya pengadilan online, pembayaran online, panggilan melalui saluran elektronik, dan percobaan yang dilakukan secara elektronik Peluncuran eCourt ini dinilai sebagai terobosan yang mampu mewujudkan uji coba yang sederhana, cepat, dan berhiaya rendah. Di sisi lain karena pandemi Covid-19, e-Court menjadi sarana bagi pencari keadilan yang memberikan kemudahan dan tidak perlu berhubungan dengan banyak orang Namun, yang perlu ditelaah lebih lanjut dan juga menjadi rumusan masalah dalam penelitian ini adalah bagaimana efektifkab sidang berbasis e-Court selama pandemi Covid-19 di PN Bekasi? Penelitian ini menggunakan metode penelitian yuridis normatif dan metode empiris, yaitu dengan menelaah primer data yang diperoleh langsung dari lokasi penelitian Haul penelitian menggambarkan bahwa berbasis e-Court sidang di masa pandemi Covid-19 di Pengadilan Negen Bekasi sudah efektif, sehingga dapat mempermudah dan mempercepat proses perkara dan mengurangi biaya Pengadilan meskipun dalam beberapa tahap proses uji coba masih konvensional yaitu pada tahap pembuktian dan pembacaan putusan

Efektivitas Penerapan Sanksi Pidana Atas Tindak Pidana Pemilihan Umum Berdasarkan Undang-undang Nomor 7 Tahun 2017 Tentang Pemilihan Umum 加强对大选重大制裁的有效性根据2017年第7号大选法采取的重大行动

Free and periodic elections have been characterized by a system of democratic states as one of the means for ensuring rights for citizens, there is often a breach in Indonesia's electoral proceedings such as the violation of criminal elections. So the government issued a special bill used to regulate the process of holding elections in 2019, specifically to sanction the perpetrators of the elections violation, using 2017's no. 7 elections.  The study adopted the normatif juridical research approach, which normatif's own jurisdiction was a law study that examined written laws from various aspects. This approach approach deals with legal matters based on the normative rules that are associated with the existing circumstances of society. By viewing a case in the public with regard to elections and linking the 2017 rule number 7 of elections for the application of sanctions against the perpetrators of the elections.             Legal certainty in the implementation of criminal sanctions against the perpetrators of the general elections under the 2017 rule of elections can be set as an example for the public to avoid committing similar crimes or others, with a sufficient number of cases to be solved. Key words: sanction setting, effective application of criminal sanctions.

This journal discusses the consideration of judges in deciding a crime of one of the Cyber ​​Crime crimes namely Carding. Especially in the case of regulating the Carding crime, the factors of the perpetrators committing the Caeding crime, as well as the consideration of the judge in giving a verdict on the Carding crime. research conducted by studying and examining library legal materials, data collection is done by examining secondary data using primary legal data in the form of a court decision. As well as secondary data. Carding is a crime that is fairly new in Cyber ​​Crime which is a transnational crime but occupies the highest position in Indonesia compared to other Cyber ​​Crime crimes. there is no specific regulation or regulation regarding the crime of Carding despite the existence of Law Number 11 of 2018 as amended by Law Number 19 of 2016 concerning Electronic Information and Transactions and the application of Articles of the Criminal Code but are deemed inappropriate. Law enforcers often have difficulty in overcoming and mismatch in upholding in preventing Carding cases, especially judges to uphold justice which is actually proven or not proven by a defendant committing a crime based on the judge's decision. Perilaku suap sudah mengakar di setiap lapisan masyarakat Indonesia dan menjadi suatu budaya koruptif yang merugikan bangsa Indonesia. Perilaku suap sudah menjadi suatu ancaman yang nyata bagi Bangsa Indonesia karena dari tahun-ke tahun seperti tidak ada kata habis, bahkan dalam perkembangannya semakin meningkat, baik dalam jumlah kasus dan kerugian negara maupun kualitasnya. Pencegahan terhadapa kecelakaan lalu lintas sudah dilaksanakan oleh pihak yang berwenang dalam hal ini Satuan Polisi Lalu Lintas dengan penegakan hukum melakukan fungsi pengawasan terhadap masyarakat secara langsung di jalan mengenai kewajiban bagi kendaraan bermotor untuk melengkapi surat perizinan dan kelengkapan alat kendaraan. Namun tindakan penegakan hukum seperti penilangan juga menimbulkan suatu masalah baru yaitu berkembang nya perilaku suap antara masyarakat dan oknum polantas. Tujuan penelitian ini adalah untuk mengetahui apa penyebab masyarakat masih melakukan tindakan suap terhadap petugas kepolisian.  Tulisan ini menggunakan metode penelitian Metode Penelitian Empiris yaitu suatu metode penelitian hukum yang menggunakan fakta-fakta empiris yang diambil dari perilaku manusia, baik perilaku verbal yang didapat dari wawancara maupun perilaku nyata yang dilakukan melalui pengamatan langsung. Hasil penelitian menunjukan bahwa perilaku suap menyuap yang dilakukan oleh masyarakat terhadap oknum polantas disebabkan oleh beberapa faktor seperti faktor ekonomi serta faktor kekeluargaan

Citizenship is a legal bond between a person and a country. Citizenship gives people an identity. According to the Universal Declaration of Human Rights affirms that "everyone has the right to a nationality", thus this declaration recognizes the importance of citizenship legally and practically for the fulfillment of human rights. Therefore, governments must work to ensure that everyone has a nationality. Former members of extremist militant organizations themselves can be interpreted as military groups (Army, Navy and Air Force), and militias and volunteer corps that meet these four requirements, are called “Former members”. They are justified in actively participating in hostilities. Also included in the ex-member group are: residents of an area that has not been occupied by the enemy, who spontaneously took up arms when organizing themselves, and carried weapons openly. Extremism is not really new. There has been a lot of extremist behavior that is usually associated with terrorist behavior and attacks against a group, both in Indonesia and abroad. Extremist behavior is slightly different from criminal behavior in general. The crimes committed by extremists are crimes based on the path they have chosen regarding their way of seeing the world. Law number 12 of 2006 concerning citizenship, it is stated in article 23 that Indonesian citizens will lose their citizenship in several ways, starting from the person concerned obtaining another citizenship, entering the service of a foreign army, entering the service of a foreign country, swearing allegiance to a foreign country. , participating in the elections of foreign countries, and several other matters mentioned in Chapter IV of the law. So even though it is true that ISIS itself is not a country as described in the writing of this thesis, this cannot be used as a basis for guiding that an Indonesian citizen who is a member of ISIS cannot lose his citizenship because it is clearly regulated in both laws and regulations. The government is what causes the Indonesian citizen to lose his citizenship automatically, not because of certain individuals who can decide whether or not a person's citizenship is lost or not.

Perlindungan Hukum terhadap Pemegang Saham yang Tidak Menyetor Modal pada Perseroan Terbatas dalam Perspektif Keadilan 从正义的角度来看,对不负担股本的股东的法律保护是有限的

Penelitian mengenai perlindungan hukum terhadap Pemegang Saham yang tidak menyetorkan modal pada Perseroan Terbatas dalam perspektif keadilan bertujuan untuk mengetahui kedudukan hukum Pemegang Saham yang tidak setor modal pada Perseroan Terbatas dalam perspektif keadilan. Metode yang digunakan ialah yuridis normatif, yaitu mengkaji data sekunder berupa bahan hukum primer, sekunder dan tertier. Hasil penelitian adalah kewajiban Pemegang saham diatur dalam Pasal 33-34 UUPT, yaitu : Pemegang saham harus menyetor penuh atas modal yang dtempatkan pada Perseroan, penyetoran modal dibuktikan dengan bukti penyetoran yang sah antara lain bukti setoran ke dalam rekening bank atas nama Perseroan, data dari laporan keuangan yang telah diaudit oleh akuntan, atau neraca Perseroan yang ditandatangani oleh Direksi dan Dewan Komisaris. Pemegang saham yang tidak setor modal tidak dapat menjalankan hak-haknya sebagai pemegang saham, karena tidak dapat membuktikan adanya penyetoran saham pada perseroan. Upaya hukum dilakukan dengan : 1) mengajukan RUPSLB melalui Penetapan Pengadilan, 2) Mengajukan gugatan perbuatan melawan hukum kepada Perseroan, 3) Melapor ke pihak kepolisian atas dugaan tindak pidana penggelapan deviden. Dari Putusan Pengadilan, Majelis Hakim menyatakan bahwa pemegang saham yang tidak menyetorkan modal, maka hak-haknya ditunda sampai dengan yang bersangkutan menyetorkan sahamnya ke dalam rekening perusahaan, Pertimbangan hukum   Majelis Hakim Pengadilan, apabila persyaratan kepemilikan saham telah ditetapkan dalam Anggaran Dasar dan ternyata  persyaratan itu “tidak dipenuhi”. Pihak yang memperoleh kepemilikan saham tersebut, tidak dapat menjalankan  hak selaku pemegang saham; antara lain  hak untuk dicatat dalam daftar pemegang saham (selanjutnya DPS), hak untuk menghadiri  dan mengeluarkan suara dalam RUPS atau hak untuk menerima dividen  yang dibagikan. Dan saham tersebut tidak diperhitungkan dalam kourum  yang harus dicapai  sesuai dengan  ketentuan  undang-undang  ini  dan   Anggaran Dasar”. Perlindungan hukum tetap diberikan kepada pemegang saham yang belum setor modal yaitu dinyatakan sah sebagai pemegang saham, namun untuk hak-hak sebagai pemegang saham belum dapat diberikan. Hal mana sesuai asas keadilan.

La dimensión ética de la significación 意义的伦理维度

This article aims to identify the basic aspects of Emmanuel Levinas’ thesis on the ethical dimension of significance. At fi rst, the author’s criticisms of two approaches to signification, called in this work: the sphere of signs (section 1) and the sphere of expression (section 2), are reconstructed. In the second moment, Levinas' thesis is stated, according to which, it is in the ethical field where the meaning finds its original meaning (section 3). Finally, some possibili-ties are identified that this Levinasian consideration of meaning opens up for discussions on perception, the contemporary crisis of meaning, and epistemology (section 4). Rather than a detailed exposition of the Levinasian theory of signification, we will point out other channels of reflection based on its ethics as a first philosophy, without getting bogged down in it.

This essay explores the impact of Harry Frankfurt’s reflections on the importance we attach to certain things in general, as well as on love as a marked way in which something or some-one can be important to us, to the fundamental question of the good life. I begin by examining the reasons why, according to the author, it is impossible to offer a non-circular answer to this question, reasons that make necessary an indirect way of approaching it. Starting from the Frankfurtian notion of importance, I then propose a critique of the so-called theory of desire, the most influential approach in current discussions about well-being or the good life. Finally, and after referring to the need, pointed out by Susan Wolf, to take into account the objective value of what matters to us, I present two considerations through which I try, with and against Frankfurt, to highlight what seems most valuable to me of his ideas about love.
