ABSTRACT: This research aims to study the phenomenon of monopoly and explain its rule and the means to address it from a juristic perspective compared to the Yemeni law, and the researcher used the inductive and deductive methods where the jurisprudential sources were consulted/ referred to with evidences from the book of Allah and The approach of the Messenger (Sunnah) providing with a discussion of the opinions of the jurists to reach the most correct opinion.The research/ study consists of two topics: The first topic: In defining monopoly and clarifying its provisions, it has three requirements: The first: the definition of monopoly in jurisprudence and the law, while the second: the rule of monopoly in jurisprudence, and the third requirement: the rule of monopoly in law. The second topic: is in the things in which the monopoly is taking place, and the means to treat it, There are three requirements: The first: The things in which monopoly takes place in the jurisprudence and law?, The second included: the Methods of monopoly in jurisprudence and the third requirement: is about monopolistic methods in the law. The results of the study indicated/ showed the following: Buying goods and materials of all kinds and collecting them from the market at the time of their shortage and licensing, so that all of them can seek profit when the need is so great for it, so It is one of the prohibited monopoly in Shariah and law, and that is legally forbidden too. The sayings of the Religious scholars were differed/ different in its ruling/ rule between the prohibition and hatred, and the researcher favors its prohibition, but it is a conditional prohibition that meets/ covers the conditions of monopoly and materials and the Yemeni law agreed with Islamic jurisprudence to prohibit the monopoly in all its forms and considered it as one of violations and set/ put for it the means and controls that limit it, and that it takes place in all goods and materials. On this basis,the Islamic law and Yemeni law didn't leave this danger to destroy the community and spread the corruption in it, but they put many methods that treat/ address this disease, if it appeared and spread in the society. One of the most important of these controls or means is that guardians or rulers warn monopolists to sell goods that they monopolize at moderate prices, If they refuse, the ruler/ judge may confiscate it and sell it to people giving them the same when it is there or give them its value, or it is priced on them, If this is not possible and they refuse to hand over what they have or pricing, here & in this case the ruler has the right to discipline/ punish the monopolists so that he is detering them and defending the harm on the people, whether through Discretionary punishment, incarceration/ Confinement, beating, or fining As based on the law or so. ABSTRACT: The study aimed to devise the educational, social and ethical contents that Surat Yassin guides, and the researcher used the analytical and deductive approach. By referring to the sources from Hadith and Tafsir, and the reasons for the descent, such as the two Sahihs and their commentaries, the interpretation of Ibn Katheer, al-Baghawi, al-Baidawi and Abi al-Saud, and access to contemporary interpretations of Surat Yassin such as Tahrir and Enlightenment by Ibn Ashour, The study came in the introduction and two topics, between the researcher in the introduction; the research problem, its goals, limitations and methodology, and the first topic dealt with the definition of Surat Yassin and its status and topics, as the second topic dealt with the educational contents in Surat Yassin. Abstract: The study aims at identifying the constraints facing the application of the Comprehensive Quality Criteria at Sa’adah University. It identifies the levels of constraints in the physical, financial and administrative fields, in addition to constraints relating to the members of staff. It also measures the impact of the two variables of sex and qualifications as viewed by the specimen’s targets. The study uses the descriptive approach, while applying the “Questionnaire” as an instrument that was distributed on a selected specimen comprising 54 members representing the complete teaching staff of the colleges at Sa’adah University. Data have been analyzed using the SPSS statistical program. Results showed that the general aggregate average for the total study’s fields reached 4.11, representing a high constraint. On the Fields level, the Physical Constraints got an aggregate average of 4.53 followed by the Financial Constraints with an average of 4.50. In the third rank came the Administrative and Regulations Constraints with an average of 3.82. Finally came the Teaching Staff Constraint with an average of 3.62, both with a grade of “Large.” Results also reflected the presence of differences at α=0.05. It is attributed to the Sex Variable in the Administrative and Regulations Field in favor of the males. While in Qualifications Field as a whole, and the Administrative and Regulations and Teaching Staff Fields, the result came in favor of those with Ph.D and M.A. No other differences were recorded in the remaining Fields. ABSTRACT: The study aimed to identify the methods and means used by the Holy Prophet in his dealings with the delegations of the Christians of Najran and Uday Ibn Hatim, and to devise advocacy and contractual issues from them, and their contemporary applications in the reality of Muslims today. To learn how the Prophet (practicing the values and principles of Islam) is practiced, by analyzing the text contained in the question and then linking it to contemporary reality, whenever possible, and the tool was represented in the diversity of methods and means that the Prophet pursued (such as dialogue, debate, wisdom and good advice, taking into account their customs, understandings and races prevailing on the side of kindness and softness, making arrivals to him more receptive to what he calls them to, and had to embody these methods and means represented by the person of the Prophet (The great impact of those coming to him, and accordingly, the Leading Prophet is the greatest leader who established the foundations of what is known today as diplomacy, and relations between countries, because of his unique personality that had a great impact in spreading Islamic preaching, The nature of the study required that it be from a preliminary and two studies. Abstract: This research included a descriptive and analytical study of a series of Al-Serafi's sayings and his syntactic views that Abu Hayyan Al-Tawhidi published in his works, from what he was asking him, or heard from him, or reading from his books, or conveying from his explanation of Siboe's book, This research has a preamble, and three topics, the preamble was entitled (the status of Abu Said Al-Serafi in his student Abu Hayyan Al-Tawhidi), and the three topics, are as follows: The first topic: issues in the origins of syntax and expression, The second topic: syntactic issues in the (noun) section, The third topic: syntactic issues in (verb, letters) sections, These topics followed by a conclusion, in which the most important results of this study have recorded. ABSTRACT: The research aimed to identify the reality of the financial incentive system (salary, bonuses, moral incentives and social services, promotions, training) and to achieve the objectives of the search for the use of descriptive analytical method, and enable the design of the researcher. By 37% of the study population (259), the results revealed the following: The overall tool received an average of (2.88 out of 5) with a verbal grade (medium), and at the axes level; the moral incentive axis got the highest average (3.50 out of 5) followed by social services with an average of (3.40) and thirdly the salary and wage axis; an average of (3.16) (2.77), and (5) promotions, with an average of (2.67), all of them verbal (medium), offset by (neutral) direction by the sample, and the financial system came in sixth place; Verbal (sparse), which means that hospital staff reject the financial system and the mechanism of bonus payment. The results also showed a positive relationship between the incentives provided and their impact on the performance of the employees, which was according to the Pearson correlation coefficient (0.57) at the level of significance (000); medium- large. There were differences due to the variable monthly financial income, which were between those with income 30 thousand and less and between 31-89 thousand on the one hand, and the category 90 thousand and more; and in favor of the category of 90 thousand and more; and depending on the years of service between those with 5 years and less and between 6-10 years on the one hand, According to the salary system, between the volunteer system and the rotation contracts and the ratio on the one hand and the salary on the other and for Saleh (salary system), there were no differences according to the variables (age - sex). By 37% of the study population (259), the results revealed the following: The overall tool received an average of (2.88 out of 5) with a verbal grade (medium), and at the axes level; the moral incentive axis got the highest average (3.50 out of 5) followed by social services with an average of (3.40) and thirdly the salary and wage axis; an average of (3.16) (2.77), and (5) promotions, with an average of (2.67), all of them verbal (medium), offset by (neutral) direction by the sample, and the financial system came in sixth place; Verbal (sparse), which means that hospital staff reject the financial system and the mechanism of bonus payment. The results also showed a positive relationship between the incentives provided and their impact on the performance of the employees, which was according to the Pearson correlation coefficient (0.57) at the level of significance (000); medium- large. There were differences due to the variable monthly financial income, which were between those with income 30 thousand and less and between 31-89 thousand on the one hand, and the category 90 thousand and more; and in favor of the category of 90 thousand and more; and depending on the years of service between those with 5 years and less and between 6-10 years on the one hand, According to the salary system, between the volunteer system and the rotation contracts and the ratio on the one hand and the salary on the other and for Saleh (salary system), there were no differences according to the variables (age - sex). Abstract: This research seeks to provide revisions to the rule of (Al-Tahlya and Al-Takhlya) with a Qur'anic vision. This is for (Al-Tahlya and Al-Takhlya) is an essential basis for building the personality of the individual Muslim, the Muslim family and the Muslim community. Additionally, it is a guide that must be present within the minds of the initiators for goodness in this nation, its preachers, reformers and those who are responsible of conducting religious guidance, educational and general awareness issues. It also seeks to achieve a number of objectives, which are: 1- to know the features of Al-Tahlya and Al-Takhlya's jurisprudence according to the Qur'anic perspective. 2- To carry out reviews of some of what was attached to Al-Tahlya and Al-Takhlya's jurisprudence and what has appeared in some of its meanings that are contrary to the true mind and the explicitly of transfer. 3- Report and confirmation two features of Al-Tahlya and Al-Takhlya's jurisprudence in the view of the Holly Qur'an, which are: First: what is meant and what deserves attention is (Al-Tahlya). Second: (Al-Takhlya) occurs by Al-Tahlia and with it; it does not advance it nor precede it. The nature of this research study required it to consist of: an introduction, preface, two sections and a conclusion, as follows: Introduction: It included the importance of studying the subject and its objectives. Abstract: The research aimed to diagnosing the reality of kindergarten curricula in the Republic of Yemen in terms of: children's learning inputs to the curriculum, problems of books and guides of nursemaids, parents' view of the role of kindergarten in the education of their children. To achieve the research objective, the two researchers used the descriptive approach. and a kindergarten card was built to collect data on the curricula reality. A questionnaire for female employees in the kindergartens to know their estimates of the problems. They were applied to 15 government and private kindergartens in the governorate of Aden 2018/2019, and (89) female employees in the kindergartens (headmistresses, supervisors, nursemaids). The research results showed the following: There are no curriculum documents in the kindergartens, with nursemaids guides available in the government kindergartens and commercial books in the private kindergartens, and that the children's learning inputs of the curricula are not sufficiently available in the kindergartens. The female employees estimation of the problems of the nursemaids guides was medium (70.2%), Within the range (68.4%- 73.00%) for domains), and the problems of the commercial books was medium (67.60%). The results also showed that there are statistically significant differences between the estimates of female employees in the kindergartens to the view of parents of the role of kindergarten in the education of their children due to the type of kindergarten: government/ private, for the benefit of female employees in the private kindergartens. The two researchers presented the most important Recommendations: Preparing a unified curriculum document for kindergartens. and develop books and guides in the light of this. مستخلص: هدف البحث إلى تشخيص واقع مناهج روضات الأطفال في الجمهورية اليمنية من حيث: مدخلات تعلم الأطفال للمناهج، مشكلات الكتب وأدلة المربيات، نظر ة الأهالي لدور الروضة في تعليم أطفالهم. ولتحقيق هدف البحث استخدم الباحثان المنهج الوصفي، وتم بناء بطاقة الروضة لجمع المعطيات حول واقع المناهج، واستبانة المشتغلات في الروضات لمعرفة تقديراتهن حول المشكلات. طبقتا على 15 روضة من روضات الأطفال الحكومية والأهلية في محافظة عدن2018/2019، و(89) من المشتغلات في روضات الأطفال (مديرات، موجهات، مربيات).و أظهرت نتائج البحث الآتي: لا توجد وثائق للمناهج في الروضات، مع توافر أدلة المربيات في الروضات الحكومية والكتب التجارية في الروضات الأهلية، ومدخلات تعلم الأطفال للمناهج غير متوافرة بشكل كاف في الروضات، وأن تقدير المشتغلات لمشكلات أدلة مربيات الأطفال كان بمستوى متوسط (70.2%) وضمن مدى (68.4%- 73.00%) للمجالات)، ومشكلات الكتب التجارية كان بمستوى متوسط (67.60%). ووجود فروق ذات دلالة إحصائية بين تقديرات المشتغلات في روضات الأطفال لنظرة أولياء أمور الأطفال لدور الروضة في تعليم أطفالهم ترجع لمتغير نوع الروضة: حكومي/أهلي، لصالح المشتغلات في الروضات الأهلية. وقد قدم البحث توصيات أهمها: إعداد وثيقة منهاج موحدة لروضات الأطفال، وتطوير الكتب والأدلة في ضوء ذلك.

To achieve the research objective, the two researchers used the descriptive approach. and a kindergarten card was built to collect data on the curricula reality. A questionnaire for female employees in the kindergartens to know their estimates of the problems. They were applied to 15 government and private kindergartens in the governorate of Aden 2018/2019, and (89) female employees in the kindergartens (headmistresses, supervisors, nursemaids). The research results showed the following: There are no curriculum documents in the kindergartens, with nursemaids guides available in the government kindergartens and commercial books in the private kindergartens, and that the children's learning inputs of the curricula are not sufficiently available in the kindergartens. The female employees estimation of the problems of the nursemaids guides was medium (70.2%), Within the range (68.4%- 73.00%) for domains), and the problems of the commercial books was medium (67.60%). The results also showed that there are statistically significant differences between the estimates of female employees in the kindergartens to the view of parents of the role of kindergarten in the education of their children due to the type of kindergarten: government/ private, for the benefit of female employees in the private kindergartens. The two researchers presented the most important Recommendations: Preparing a unified curriculum document for kindergartens. and develop books and guides in the light of this. مستخلص: هدف البحث إلى تشخيص واقع مناهج روضات الأطفال في الجمهورية اليمنية من حيث: مدخلات تعلم الأطفال للمناهج، مشكلات الكتب وأدلة المربيات، نظر ة الأهالي لدور الروضة في تعليم أطفالهم. ولتحقيق هدف البحث استخدم الباحثان المنهج الوصفي، وتم بناء بطاقة الروضة لجمع المعطيات حول واقع المناهج، واستبانة المشتغلات في الروضات لمعرفة تقديراتهن حول المشكلات. طبقتا على 15 روضة من روضات الأطفال الحكومية والأهلية في محافظة عدن2018/2019، و(89) من المشتغلات في روضات الأطفال (مديرات، موجهات، مربيات).و أظهرت نتائج البحث الآتي: لا توجد وثائق للمناهج في الروضات، مع توافر أدلة المربيات في الروضات الحكومية والكتب التجارية في الروضات الأهلية، ومدخلات تعلم الأطفال للمناهج غير متوافرة بشكل كاف في الروضات، وأن تقدير المشتغلات لمشكلات أدلة مربيات الأطفال كان بمستوى متوسط (70.2%) وضمن مدى (68.4%- 73.00%) للمجالات)، ومشكلات الكتب التجارية كان بمستوى متوسط (67.60%). ووجود فروق ذات دلالة إحصائية بين تقديرات المشتغلات في روضات الأطفال لنظرة أولياء أمور الأطفال لدور الروضة في تعليم أطفالهم ترجع لمتغير نوع الروضة: حكومي/أهلي، لصالح المشتغلات في الروضات الأهلية. وقد قدم البحث توصيات أهمها: إعداد وثيقة منهاج موحدة لروضات الأطفال، وتطوير الكتب والأدلة في ضوء ذلك.","PeriodicalId":240179,"journal":{"name":"Journal of the Arabian Peninsula Center for Educational and Humanity Researches","volume":"102 1","pages":"0"},"PeriodicalIF":0.0,"publicationDate":"2019-10-30","publicationTypes":"Journal Article","fieldsOfStudy":null,"isOpenAccess":false,"openAccessPdf":"","citationCount":null,"resultStr":null,"platform":"Semanticscholar","paperid":"123516502","PeriodicalName":null,"FirstCategoryId":null,"ListUrlMain":null,"RegionNum":0,"RegionCategory":"","ArticlePicture":[],"TitleCN":null,"AbstractTextCN":null,"PMCID":"","EPubDate":null,"PubModel":null,"JCR":null,"JCRName":null,"Score":null,"Total":0}
Abstract: The study aimed at identifying the extent to which the semester exams conform to the scale of the teaching units, Bloom's cognitive objectives and the levels of difficulty and recognition. The two researchers used the descriptive-analytic approach. The study sample consisted of (13) semester exams of the first semester of the academic year 2018-2019 in the Faculty of Education – Almahrah. It included (416) questions, which were analyzed by means of an analysis form designed for this study. The study reached a set of results such as: the teaching staff employs essay questions at (68.27%) more than objective ones that reached (31.73%). It illustrated that there is a difference in the representation of the scale of the teaching units in the semester exams, indicating that 11 teaching units at the scale of (10.06%) were not represented in the semester exams, while (17) teaching units were represented, though, less than its eligible scale at (13.51%). As for the total number of questions, (26) teaching units were represented, increasing above the eligible scale at (23.22%). The results also indicated a high ratio of the objectives at the two levels of comprehension and recollection at (67.31%) of the total number of questions, whereas the percentage of the representation of the higher levels of application, analysis, composition and evaluation decreased at (32.69%). Moreover, the study concluded that the overall difficulty level of the exams reached (0.28) and the recognition level (0.27). The study recommended the necessity of configuring semester exams in view of table specifications and good exams standards. الملخص: هدفت الدراسة إلى التعرف على مدى تمثيل الاختبارات الفصلية لأوزان الوحدات الدراسية، وأهداف بلوم المعرفية، ومستويات الصعوبة والتمييز فيها، واستخدم الباحثان المنهج الوصفي التحليلي، وتكونت عينة الدراسة من (13) اختباراً (فصلياً) من اختبارات الفصل الدراسي الأول للعام الجامعي 2018-2019، بكلية التربية بمحافظة المهرة، تضمنت (416) سؤالا، تمَّ تحليلها بواسطة استمارة تحليل بُنيتْ لهذا الغرض، وتوصَّلت الدراسة إلى مجموعة من النتائج، أهمها: أن أعضاء هيئة التدريس يستخدمون الأسئلة المقالية بنسبة (68.27%)، أكثر من الأسئلة الموضوعية والتي بلغت نسبتها (31.73%)، وأوضحت أن هناك تباينا في تمثيل الاختبارات الفصلية لأوزان الوحدات الدراسية، حيث دلت أن (11) وحدة دراسية وزنها (10.06%)، لم يتم تمثيلها في أسئلة الاختبارات الفصلية، بينما مثلت (17) وحدة دراسية بأقل من وزنها المستحق بـ (13.51%)، وكان تمثيل (26) وحدة دراسية بزيادة عن الوزن المستحق بـ (23.22%) من إجمالي الأسئلة الكلية، كما أظهرت النتائج ارتفاع نسبة تمثيل أهداف مستويي: (الفهم والتذكر)، بنسبة (67.31%)، من إجمالي الأسئلة، في حين انخفضت نسبة تمثيل المستويات العليا: (التطبيق، التحليل، التركيب، التقويم)، حيث بلغت (32.69%)، وتوصلت إلى أن درجة صعوبة الاختبارات ككل بلغت (0.28)، ودرجة تمييزها (0.27). وأوصت الدراسة بضرورة بناء الاختبارات الفصلية في ضوء جدول المواصفات ومعايير الاختبار الجيد.
