espanolLa responsabilidad de la Administracion Publica y el contencioso administrativo constituyen dos garantias basicas que configuran el regimen administrativo en el Estado de derecho. La funcionalidad de ese binomio permite articular las pretensiones indemnizatorias de los ciudadanos ante el poder publico por las lesiones a sus derechos e intereses legitimos. En Cuba, el desarrollo de este binomio ha sido limitado no solo en el orden teorico, sino en su regulacion normativa y realizacion practica, restando eficiencia a su rol garantista en el diseno de derechos y garantias reconocido en el orden constitucional. Sobre esa base, la investigacion tiene como objetivo argumentar las limitaciones dogmaticas del acceso a la justicia administrativa en Cuba en procesos de responsabilidad patrimonial de la Administracion Publica, a efectos del perfeccionamiento de su regimen juridico. Para ello, la exposicion de ideas se distribuira en cinco ejes cardinales, partiendo del acceso a la justicia administrativa en Cuba para adentrarse en la configuracion de la legitimacion activa y pasiva para su exigencia, el objeto del contencioso de responsabilidad, para culminar las valoraciones sobre la relacion organo, jurisdiccion y competencia. La investigacion concluye por destacar la necesidad de una reforma de nuestra legislacion del contencioso que se pronuncie por un pleno acceso a su justiciabilidad sobre la base de las deficiencias determinadas, acompanada de la modificacion de los criterios interpretativos con que se maneja nuestra jurisprudencia administrativa, para el logro de la justiciabilidad de la responsabilidad de la Administracion Publica. En un caso que involucraba un episodio de violencia machista cuya crudeza no ha dejado indiferente a la opinion publica, la Corte Suprema decidio, acogiendo en tal medida el recurso de nulidad interpuesto por la defensa del condenado, revocar la condena por femicidio frustrado que, junto a otras dos condenas, una por violacion de domicilio y otra por lesion grave gravisima en los terminos del numeral 1 del articulo 397 del Codigo Penal, fuera pronunciada por el Tribunal de Juicio Oral en lo Penal de Coyhaique (el tribunal). Por decision de mayoria, y en contra del parecer manifestado por el ministro Juica en su voto disidente, la segunda Sala de la Corte declaro infundada la primera condena, sustituyendola —a traves de la correspondiente de reemplazo— por una condena por lesion corporal simplemente grave en los terminos del numeral 2 del articulo 397 del Codigo Penal, quedando esta anadida, entonces, a las dos condenas que no fueron objeto de anulacion.

Explica que todo ello era previsible para el gobierno militar y sus economistas civiles hacia 1981; que las causas de la crisis fueron introducidas deliberadamente por las autoridades publicas; que se dejo crecer la crisis hasta el nivel que alcanzo con la finalidad de asegurar el sistema economico de feroz neoliberalismo instaurando a partir de 1974; y que la falta en la legislacion de delitos apropiados para castigar las conductas criminales que ocurrieron antes y durante la crisis, no fue ni es todavia en absoluto una casualidad. The article critically describes and analyzes the different forms of preventive detention in the Alfredo Etcheberry’s Draft Penal Code for Chile, considering the existing constitutional limitations. It is concluded that only preventive detention for persons prone to crime would be constitutionally legitimate, since it has a purpose in accordance with international treaties (social reintegration) and a foundation compatible with constitutional order (the proven danger of the agent’s reiteration). In addition, it has a post-criminal nature, offers voluntary programs of social reintegration, has a maximum limited duration and would be subject to periodic review by the courts. The rest of the proposed measures, however, do not appear to be legitimate, in the light of constitutional limitations.

The justifying «aggressive state of emergency» (section 34 of the German Criminal Code/StGB) is a challenge to liberal criminal legal Systems, as it imposes a legal obligation to tolerate an intrusion into his own legal sphere onto an innocent bystander. This obligation is traditionally based on the notion of «weighing of interests», which is, however, not convincing due to the utilitaristic structure of this idea. More recently, the topos of «solidarity» has replaced the traditional approach as a basis of legitimation, but this topos is not more than a mere catchphrase, as long as it lacks a reasonable justification. To close this justification gap, it is widespread to use prudential considerations. Accordingly, it is prudent for every citizen to agree on a rule along the lines of section 34 StGB with his fellow citizens, for the sake of minimizing his own risks of life. But this approach cannot convincingly answer the question regarding the reason for the obligation imposed by the «state of emergency» rules. Additionally, it falsifies the quality of legal wrong that a citizen commits by breaching his obligation during the state of emergency. Therefore, this essay suggests to see the «offender» who is justified by a state of emergency as representative of the State’s caring society (staatliche Solidargemeinschaft). The right to solidarity, that can be claimed by any citizen in a state of emergency, is directed against his fellow citizens as a whole, just as in all other cases of need through no fault of one’s own. The precise individual person the duty is actually imposed onto is merely a «transit station». Therefore, only such duties may be imposed onto him that can be compensated afterwards, and the community must also ensure that such compensation actually takes place.

The article aims to make a succinct study of the crime of terrorism financing in Chile, reviewing the legislation affecting both natural persons (Article 8 of Law 18.314) and legal entities (Law 20.393). In addition, we do a study of the historical-legislative context in which the crime was introduced, together with an analysis of the phenomenon of the terrorism financing in the world. Then a dogmatic analysis of the criminal figure in Chile is carried out, making some critical observations in his case, on some specific points of the legislation about of the crime of terrorism financing.

The author suggests that we understand the problem of the principles in Prof. Em. Etcheberry’s Penal Code Project, as an issue about the origins or the beginnings of codification, rather than as an exploration of the values that underlie the specific rules contained in the project. This going back to origins should not be understood in conservative ways as a regression, but rather as a logical return to the conditions that allow us to understand criminal law as a practice that can inhabit the world of the law.

This paper provides a brief description of the state of affairs on the issue of implementation of fundamental rights of the citizens in administrative penalty procedures, based on some statements of the Chilean courts of justice. Here it is propose uprightly to abandon the search for a «supposed natural or ontological identity» between administrative offense and criminal offense. Under these assumptions, we conclude that a rational understanding of the tools that the administration has, to determine their duties, can finally help as a clarification of the historical relationship between administrative penalty and punishment.

This paper gives the results of the research conducted at the Pontificia Universidad Catolica del Peru (PUCP) entitled «The language of the judges and the right of access to justice for persons in vulnerable situations. Pilot project». This research project aimed to explore the current state of judicial language written in family court proceedings and alternatives to improve their understanding. According to our hypothesis , the clarity of judgments in family proceedings involving people in a vulnerable situation, depends not only on the texts are drafted with syntactically and orthographically correct language, but other factors relating to the situation specific language of the target group of judicial decisions. The fieldwork of the research project was conducted in the Southern Judicial District of Lima. In this judicial district we conducted interviews with a group of judges and organized a workshop and reading comprehension test of judgments with a group of women belonging to a social organization. The results show a part that judges interviewed have severe difficulties to write clearly judgments that are directed to the citizens of vulnerable populations. Furthermore, it was found that test participants understanding of court rulings women do not understand the technical language of judgments and there is ample scope for simplifying and improving the texts. The research results have been organized into three sections. In the first one we present the theoretical framework of the research: the relationship between law and language, the concept of judicial language and the constitutional status of the right to language comprehension of judges. In the second section the place, purpose, method, results and conclusions of the fieldwork is exposed. Finally, in the third section, the main trends that show international experiences to address the situation.
