A Comparative Study of Controversial Types of Hirabah (Banditry) in Islamic Jurisprudence and Yemeni Laws 伊斯兰法理学与也门法中有争议的“强盗”类型比较研究

This paper investigated the controversial types of Hirabah for three reasons: to the best of the researcher's knowledge, it is a new topic that has not been investigated independently; the focus has been on the agreed types only. Secondly, this topic focuses on a vital issue in society; and finally it paves the way for future studies of Mohareb offences. The paper aimed to identify controversial types of Hirabah, its rules, and to examine the possibility of applying Hirabah elements (to them) as well as the perspective of Yemeni laws about Hirabah. For defining the types of Hirabah, the analytical descriptive method was followed, and for comparing and tracking various opinions and views, the comparative inductive method was used. The study concluded that Hirabah controversial types should be penalized as the rules of Hirabah apply to them. This fulfills the purposes of jurisprudence in protecting the society security and public interests, and preventing such crimes. It was recommended that Yemeni penal code be reviewed to conform with Islamic jurisprudence and general penal code; and collective Ejtehad and making use of the potential of Islamic criminal law regarding formation of appropriate legal opinions for the current crimes should be taken into consideration. An Analysis of a New Musnad Inscription Related to Wars of Sabaʾ and dhū-Raydān Kings Found in Rayda City 雷达城发现的一件与萨巴国王和dhú-Raydān国王战争有关的新Musnad铭文分析

This research paper aimed to study the linguistic and historical connotations contained in the inscription (Al-Qayli-Rayda 1), which is an unpublished musnad inscription, representing a memorial text of the inscriptions of wars and military campaigns originating from the city of Rayda which is currently in the village of Bayt al-Qufāf, Ḫarif district, ʿAmrān, Yemen. To achieve this objective, the descriptive comparative analytical method was used. The analysis revealed that the events stated in the inscription date back to the era of the kings of Sabaʾ and  dhū-Raydān (circa 3rd century AD). The inscriptions bnw S¹ʾrn w-Mḥylm indicate that there were a number of battles which can generally be divided into two campaigns. The first was launched by Rubʿ Rayda of Bakīl on the Bedouins, who had conquered ʿrn Baraṭ and some of the surrounding areas and valleys, and whose danger began to reach the eastern boundaries of Ḥas²id and Bakīl tribes. In the second campaign, the Rubʿ Rayda and other ʾArbāʿ of Bakīl under the command of a Kabīr Aqyānum and Ibn Marthadum, along with the king of Sabaʾ and  dhū-Raydān (their names can be found in the left broken part of the inscription) launched the campaign, and headed to the​​ S¹uhrat area to fight the ʾAshā‘ir tribe and its leader Nabat. The inscription is a new addition to Yemen's political history before Islam. It includes the areas on which the campaigns were launched and the methods and techniques used during the battles. Impact of Strategic Flexibility on the Performance of Yemeni Universities 战略灵活性对也门大学绩效的影响

This study aimed to measure the impact of strategic flexibility (competitive flexibility, resilience of resources) on the performance of Yemeni universities in these dimensions: profitability, market share, social responsibility, customer satisfaction and scientific research. It also aimed to identify any differences among the participants' responses regarding the performance of Yemeni universities attributed to two variables: type and name of university. To achieve the study objectives, the descriptive analytical method was used. The study population was the academic and administrative leaders in Yemeni universities from which a sample of 301 members were selected by the complete census method. To analyze the data, the SPSS was used to apply descriptive and inferential statistical methods. Study results revealed an interest in practicing strategic flexibility by the Yemeni universities under investigation. There was a disparity between the level of achieving the dimensions; the most achieved one was 'market share', whereas the least one was 'profitability'. There was also a disparity in the impact of strategic flexibility dimensions on the performance of universities, where the most influential one was 'competitive flexibility; and the least influential one was 'resilience of resources'. Further, there was convergence in the level of university performance in terms of their type, while there was a difference in the level of university performance according to their name. It was concluded that Yemeni universities should increase their practice of strategic flexibility because of its positive impact on achieving their performance. Effect of Some Variables on the Level of Health Behavior among Faculty Members at the University of Science and Technology – Yemen 一些变量对也门科技大学教师健康行为水平的影响

The aim of this study was to identify the level of health behavior of faculty members at the University of Science and Technology- Yemen; and to what extent this level is affected by some variables, such as gender, age, marital status, academic level, college type and years of experience. To achieve the study objectives, the descriptive method was followed; and a test of the level of health behavior, consisting of certain health aspects and five dimensions, was used. Some items of the test were modified by the researcher in order to adapt them to the Yemeni context. The study sample consisted of 125 faculty members, but 94 of them took the test. The study results revealed that the level of health behavior among faculty members was medium. There were no statistically significant differences in the level of health behavior attributed to these variables: gender, age and college type. However, there were statistically significant differences in the level of health behavior attributed to these variables: marital status, academic level and years of experience. It was recommended that the study findings be taken into consideration to develop and plan programs for promoting health behavior and raising the level of health awareness and culture of organizational change in the university in particular and in the Yemeni society in general. The Extent of Confronting Sectarian Intolerance in the Philosophy Course from the Perspective of Second Year High School Pupils in Tebessa, Algeria 从阿尔及利亚Tebessa高中二年级学生的角度看哲学课程中面对宗派不容忍的程度

The purpose of this study was to find out whether the philosophical texts of the Philosophy Curriculum for the second year of high school pupils in Tebessa, Algeria were written in a manner that makes pupils able to overcome sectarian intolerance. It also aimed to find out the role of the evaluation process in terms of tools and methods adopted in the course to achieve the set objectives of the curriculum. To achieve the study objectives, the descriptive exploratory method was followed, and a questionnaire for data collection, developed by the researcher, was used after checking its validity and reliability. The study sample consisted of (190) male and female pupils, who were selected by the complete census method. The findings of the study revealed that the content of the curriculum relatively supports the ability to overcome sectarian intolerance, and that the process of evaluation contributes to the achievement of the intended objectives. The study concluded the need to pay more attention to the philosophy texts that strengthen the ability to overcome sectarian intolerance among pupils. The study also stressed the need to increase the number of times for evaluating the philosophy course. هدفت الدراسة إلى التعرف على العلاقة بين مستوى المناخ المدرسي ومستوى التوافق الدراسي لدى طلبة المرحلة الثانوية بمدارس أمانة العاصمة صنعاء، واعتمدت الدراسة على المنهج الوصفي الارتباطي، وتم استخدام مقياس المناخ المدرسي الذي أعده الباحث، ومقياس التوافق الدراسي الذي قنن على البيئة العربية، وتكونت عينة الدراسة من (600) طالبِ وطالبة، تم اختيارهم بالطريقة العنقودية. وتوصلت الدراسة إلى أنَّ: مستويي المناخ المدرسي والتوافق الدراسي لدى طلبة المرحلة الثانوية بمدارس أمانة العاصمة صنعاء متوسط، ووجود علاقة ارتباطية إيجابية ذات دلالة إحصائية عند (a £ 0.05) بين مستوى المناخ المدرسي ومستوى التوافق الدراسي، ووجود فروق ذات دلالة إحصائية عند (a £ 0.05) في مستوى المناخ المدرسي وفقاً لمتغير النوع لصالح الإناث، ووفقاً لمتغير نوع المدرسة لصالح طلبة المدارس الأهلية، وعدم وجود فروق ذات دلالة إحصائية عند (a £ 0.05) في مستوى المناخ المدرسي وفقاً لمتغير التخصص، وعدم وجود فروق ذات دلالة إحصائية عند (a £ 0.05) في مستوى التوافق الدراسي وفقاً لمتغيرات النوع والتخصص ونوع المدرسة. وأوصت الدراسة بالعمل على تحسين مستوى التوافق الدراسي من خلال تهيئة المناخ المدرسي الذي يشجع الطلبة على الجد والاجتهاد والمثابرة والانضباط وعلى الطاعة والإذعان للمدرسين والإدارة المدرسية.

The Mental Image of the Yemeni National Security among Journalists 记者对也门国家安全的心理形象

The study aimed at developing the love of learning scale for adults. The scale consisted of 15 situations to measure three dimensions namely intimacy, passion, and commitment towards learning. The scale was standardized on a sample of 111 university male and female students from the 4th level of the Faculty of Education, Sana’a University, Yemen. The validity and reliability of the scale was (0.81) based on Cronbach’ Alpha. The results of the study showed that the level of the love of learning was of average level.
本研究旨在开发成人学习爱好量表。量表由15种情境组成,分别测量亲密度、热情度和学习承诺度三个维度。该量表以也门萨那大学教育学院4级111名大学男女学生为样本进行标准化。量表的效度和信度为(0.81)。研究结果表明,大学生的学习爱好水平处于中等水平。

Public-Private Partnership in Yemeni Law and its Role in Overcoming Contemporary Challenges 也门法律中的公私伙伴关系及其在克服当代挑战中的作用

The public-private partnership has gained great interest as the economic and social development process depends on mobilizing and gathering all the potentials of the society to participate in establishing and operating various projects. This may help the independent institutional organizations to overcome the challenges and difficulties and achieve their goals at the target levels. Therefore, both developed and developing countries seek to create institutional structures, legislations and systems to adopt participatory organizations in which all sectors of society contribute to serving their objectives on the basis of cooperative participation, good governance, transparent accountability and mutual benefit. This entails the need to keep pace with the necessary legislations. Thus, the study aims to analyze the legislative requirements in light of development needs and practical and administrative problems applying the concepts of transparency, disclosure and cooperation. The scientific method which is based on the analysis and the comparison approach was adopted to achieve the required results and provide the relevant and appropriate recommendations in this field. The main findings of the study revealed the urgent need to activate the partnership between the public and private sectors in the Republic of Yemen. This requires reviewing the relevant legislations and enacting complementary laws to achieve the objectives of partnership between public and private sectors. The Impact of Human Capital on Organizational Performance: A Field Study at the Mobile Phone Companies in Yemen 人力资本对组织绩效的影响:也门移动电话公司的实地研究

The study aimed at identifying the impact of human capital on organizational performance in four mobile companies in Republic of Yemen (MTN, Yemen Mobile, SabaFon, and Y). The study used the descriptive analytical method to answer the study questions and test the hypotheses. For the purpose of data collection, a questionnaire was developed and distributed to the sample of the study which is 327 employees selected from all the organizational levels. The data were analyzed using simple regression analysis. The findings of the study indicated that there is a significant impact of human capital on organizational performance at mobile phone companies in Yemen. Findings also showed that among human capital dimensions; knowledge was the most influential dimension on organizational performance. In light of the study results, it is recommended to pay great attention to human capital by improving the employees' skills and capabilities through training courses and workshops. The study also recommended engaging the employees in setting the organization’s policies and plans, and considering their suggestions and views which may improve the organization and achieve its goals.
