The purpose of the research is a comprehensive analysis of approaches to the legal terminological use in the modern world, highlighting legal terminological peculiarities. The article uses general scientific and special-scientific research methods, in particular, dialectical, formal-logical, analysis and synthesis, formal- legal, and other methods of scientific knowledge. The study revealed application legal terminological peculiarities in the modern world. It is emphasized that legal concepts are vital for the proper functioning of legal institutions. It is noted that the majority of legal terms are aimed at unambiguous and consistent interpretation of legal texts, which are established at the normative level in various legal documents. At the same time, the boundaries of vast subject areas are unclear, and their use in different law areas may cause, as a result, the application of different criteria to establish the essence of the term. It is noted that the legal terminological research should focus on the legal solution elements to a real life problem.

The purpose of the scientific research is a detailed analysis of theorganization and activity of the national intellectual property body in European countries. The analysis of the European experience of intellectual property bodies is a necessary foundation for the Ukrainian mechanism in the context of the implementation of positive aspects and integration into the European environment. Research methods were used: systematization, comparative method, generalization; analysis and synthesis of ideas developed. On the basis of the conducted analysis, taking into account the study of positive European experience, recommendations were developed for possible implementation into national legislation in the researched area. As a result of the conducted research, it was concluded that in such European countries as Great Britain, France, Germany, Spain and Poland, a single universal model of building national intellectual property bodies has not been developed; each State has a special system of intellectual property bodies; at the same time, despite the diversity of sub-departments and the organizational structure of the national intellectual property bodies of each of these countries, there are several common features.

The paper aims at developing recommendations for improving procedural laws and guiding case law related to reasons for a supreme court to overrule its universally binding legal opinions with a particular emphasis on relevant Ukrainian legal context as a perfectly illustrative example. This research purpose prompts the reliance on a set of appropriate scientific methods of descriptive and comparative law research including the comparative analysis itself as a fundamental instrument for review of relevant legal material, as well as the structural, analytical and law-in-context scientific methods. The paper covers, in particular, a)Ukrainian statutory framework and case law regulating of the Supreme Court of Ukraine's departure from its legal opinions; b)concepts of overrulingprecedents of the highest courts of the most developed countries with common law legal system; c)current views of scientific community and prospects of development of the relevant case lawon Supreme Court of Ukraineoverruling its legal opinions.The authors maintain that it is extremely important to substantiate compelling reasons for a supreme court to review its vision of the correct application of the Law, exposing the reasons for considering the previous one defective, to the extent that it leads tofundamental negative consequences.

Como estrategia para promover y apoyar el uso sostenible de los recursos hídricos, se estimó la huella hídrica del cultivo de cacao; además se identificaron y caracterizaron los procesos de cosecha de cacao para evaluar el impacto en los volúmenes de agua utilizado en dichos cultivos, se midió la evapotranspiración del agua verde y el agotamiento del agua azul que se encuentra en la cuenca de los ríos. Las estimaciones se llevaron a cabo siguiendo la metodología propuesta por (Hoekstra et al., 2021), considerando los datos locales necesarios para la estimación del uso de agua verde y azul en CROPWAT 8.0. Se encontró que los valores correspondientes a la HHV son menores que la media para Ecuador y que el valor económico de la huella hídrica del cultivo de cacao, es menor que el VET de la HH de los hogares y negocios de un sector de Guayaquil.

El objetivo del presente artículo fue describir resultados de la investigación sobre las competencias interpersonales para favorecer el quehacer investigativo en docentes de una universidad particular de Guayaquil, en el 2022. Al respecto, el ejercicio del profesional como formador e investigador se entiende a partir de los procesos reflexivos de la realidad social para entenderla y transformarla. La metodología aplicada respondió a un enfoque cuantitativo, no experimental y de tipo descriptiva. La población estuvo conformada por cincuenta docentes, con una muestra no probabilística y se utilizó como instrumento, el cuestionario. Desde esta mirada, el análisis estadístico fue realizado con el software SPSS para recopilar datos y lograr la información requerida. Como parte de los hallazgos se encontró la necesidad de fortalecer la dimensión del autoconocimiento y la conciencia social, para que el docente se identifique como un aprendiz que busca el mejoramiento continuo en la visibilidad de las competencias científicas.

The objective of this article is to analyze the problems of the interaction between International Law and the Law of the European Union. In particular, attention is paid to the study of "traditionalist" and "autonomist" approaches to the relationship between International Law and EU Law, the place of EU Law in the international legal order and the international legal aspects of the interaction of EU law and the law of the EU Member States. In the investigation, dialectical, legal-comparative, historical and logical-formal methods were used. As a result of the analysis, it was concluded that the relationship between EU Law and International Law is difficult to fit into any of the traditional models. On the one hand, EU Law was formed as a component of International Law. On the other hand, although the EU legal order was created on the basis of international treaties, in the process of its development it acquired certain characteristics that are, to a certain extent, characteristic of national legal orders.

The aim of this research is to determine how emotional intelligence trait adaptability is integrally developed through physical education of scholar`s with severe special educational needs.To achieve this aim firstly a research question was formulated how is the adaptability trait developed during various social and educational contexts of physical education? This research is based on the fundamentals of qualitative microethnographic research. Several data collection and analysis methods were used: scientific literature analysis, video recordings, Braun and Clarke`s reflexive analysis, latent coding using the Huber and Froelich method of sequential analysis. The results revealed 13 sub-themes and 7 themes which generated these main conclusions: The adaptation trait for scholars with severe special educational needs can be developed through various social interactions and educational contexts, which usually are constructed by the teacher, on an individual, group levels and in some cases multidimensionally, independent on the phase of the lesson, hence the activity itself is most important, thus making physical education a preferable context for such development.

Cuando se trata de la obtención de habilidades comunicativas en inglés, su importancia no puede discutirse. Quienes realizan estudios de educación superior requieren tener las potencialidades para mantenerse actualizado, los alumnos para aprender y, los docentes para enseñar. Así, este artículo se plantea como objetivo, una lectura crítico-hermenéutica de las circunstancias actuales en las que se desarrolla el proceso enseñanza aprendizaje del idioma inglés en el contexto universitario de Ecuador. Parte de un diseño documental que recaba información de las estrategias pedagógicas en la enseñanza del inglés, considerando la importancia que tiene esta lengua en el proceso de prosecución intelectual y laboral de los estudiantes universitarios. Es sabido que, a raíz de algunos cambios curriculares ocurridos en la segunda década del siglo XXI, el sistema de educación ecuatoriano incluye la enseñanza del inglés en la Educación General Básica y en Bachillerato, algo que impulsa su valoración en niveles superiores. En el ámbito universitario, el análisis de la literatura sobre el tema y la lectura crítica hermenéutica deja ver que el aburrimiento de los estudiantes y su desmotivación, tiene entre otras causas, la poca innovación de los docentes, quienes tienden a trabajar en función de la lectura de libros- textos con pocos incentivos para un aprendizaje significativo y colaborativo. Se muestra un análisis de efectos de sentido en las caricaturas de Fernando Pinilla a partir de los aportes de Michel Pêcheux, referentes a la memoria y formación discursiva de la línea francesa del Análisis del Discurso. Se seleccionaron intencionalmente 4 caricaturas de su cuenta de Instagram en enero del 2022 consideradas por representar la situación económica y social de Venezuela. Se apreció una memoria discursiva marcada por el uso de metáforas, basadas en monstruos, personajes infantiles y animales, la ironía, el uso constante del rojo y blanco para describir una realidad en un momento sociohistórico. Se evidenció una formación discursiva crítica del autor que resalta irónicamente la actitud positiva del gobierno a pesar de las condiciones del país.

Se seleccionaron intencionalmente 4 caricaturas de su cuenta de Instagram en enero del 2022 consideradas por representar la situación económica y social de Venezuela. Se apreció una memoria discursiva marcada por el uso de metáforas, basadas en monstruos, personajes infantiles y animales, la ironía, el uso constante del rojo y blanco para describir una realidad en un momento sociohistórico. The purpose of the article is the analysis of the provisions of the first Constitution of Romania of 1866 in terms of guaranteeing of Human Rights and freedoms by the state. The article points out that the adoption of the Constitution of 1866 became a fateful state legal act for the entire Romanian people, since it meant a radical change in the ratio of external and internal factors in the state-building process of the Romanian state. To achieve this goal, general scientific and special-scientific methods of cognition were used, in particular, dialectical-legal-comparative, legal-formal. It has been determined that the accepted Constitution in 1866 in terms of guaranteeing Human Rights and freedoms has had a truly liberal character and has become the progressive state-legal act for the state-building process of Romania; the need to follow the norms of the Basic Law gradually have made constitutionalism as the form of thinking, which has contributed to the further expansion of democratic rights and freedoms and the development of the democratic views in the country.
